2303ORDINANCE NO. 2303 COUNCIL MEMBER WOLFF INTRODUCED THE FOLLOWING ORDINANCE: AN ORDINANCE AMENDING THE CITY OF BLAIR ZONING REGULATIONS, ARTICLE 3, SECTION 303 -DEFINITIONS CREATING A DEFINITION FOR STORAGE, INDOOR AND OUTDOOR; AMENDING ARTICLE 8 — A/CH/(AGRICULTURAL/HIGHWAY COMMERCIAL DISTRICT), SECTION 801.04 -EXCEPTIONS; AMENDING ARTICLE 9 — A/ML (AGRICULTURAL/LIGHT INDUSTRIAL AND MANUFACTURING DISTRICT), SECTION 901.02 -PERMITTED PRINCIPAL USES AND STRUCTURES AND SECTION 902.02 -PERMITTED PRINCIPAL USES TO ALLOW STORAGE, INDOOR AND OUTDOOR; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT AND PROVIDING FOR PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1 That Article 3, Section 303 DEFINITIONS of the Blair Zoning Regulations of Blair, Nebraska is hereby amended as follows, to wit: 303.01 TEXT OF DEFINITIONS: Words or terms not herein defined shall have their ordinance meaning in relation to the context. For the purposes of this Ordinance certain words and terms used herein are defined as follows: (145) STORAGE UNITS, MINI: Storage units primarily for the storage and housing of personal property including but not limited to household goods, boats, motor vehicles, with each unit generally not exceeding two hundred (200) square feet. (145.1) STORAGE, INDOOR AND OUTDOOR: Storage, either inside a building or group of buildings, or outside, used for the storage and housing of personal property including but not limited to boats, motor vehicles and recreational vehicles, containing controlled access units or delineated open areas for individual use. Outdoor storage shall be enclosed by a fence or wall at least six (6) feet in height. Items stored outdoors must be designed for outdoor use. SECTION 2 That Article 8-A/CH AGRICULTURAL/HIGHWAY COMMERCIAL DISTRICT, Section 801.04 Exceptions of the Blair Zoning Regulations of Blair, Nebraska is hereby amended as follows, to wit: 801.04 EXCEPTIONS: After the provisions of this Ordinance relating to exceptions have been fulfilled, the City Council may permit the following conditional uses as exceptions in the A/CH Highway Commercial District in accordance with ARTICLE 14 of this Ordinance. (5) Storage Units, Mini; (20) Storage, Indoor and Outdoor: This use shall not be permitted on lots with highway frontage. All outdoor storage areas which are located within one hundred feet (100') of the right of way, or within five hundred feet (500') of a Federal Aid Primary or Federal Aid Secondary designated street or highway, shall be hard surfaced with concrete, asphalt, recycled asphalt or asphalt millings. SECTION 3 That Article 9-A/ML AGRICULTURAL/LIGHT INDUSTRIAL AND MANUFACTURING DISTRICT, Section 901.02 PERMITTED PRINCIPAL USES AND STRUCTURES of the Blair Zoning Regulations of Blair, Nebraska is hereby amended as follows, to wit: 901.02 PERMITTED PRINCIPAL USES AND STRUCTURES: The following shall be permitted as uses by right except when located within 500 feet of any Residential District, in which case a conditional use permit will be required to allow the following uses: (1) Wholesale, and warehouse uses; (20) Storage, Indoor and Outdoor: All outdoor storage areas which are located within one hundred feet (100') of the right of way shall be hard surfaced with concrete, asphalt, recycled asphalt or asphalt millings. SECTION 4 That Article 9-A/MH AGRICULTURAL/HEAVY INDUSTRIAL AND MANUFACTURING DISTRICT, Section 902.02 PERMITTED PRINCIPAL USES AND STRUCTURES of the Blair Zoning Regulations of Blair, Nebraska is hereby amended as follows, to wit: 902.02 PERMITTED PRINCIPAL USES AND STRUCTURES: The following shall be permitted as uses by right except when located within 500 feet of any Residential District, in which case a conditional use permit will be required: (1) Wholesale, and warehouse uses; (8) Storage, Indoor and Outdoor: SECTION 5 All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6 This ordinance shall be in full force and effect from and following the passage and publication hereof as required by law and providing for publication of this ordinance in pamphlet form.
