PO Box 1
BENNINGTON, NE 68007
RE: 1311 Prospect Ave
Dear Mr. Logemann:
This is a courtesy letter to notify you that we have received a complaint regarding a golf cart and
parked vehicles blocking the right-of-way on the south edge of your property located at the above
address. This is a violation of the following municipal codes:
Code Description
05-411 VEHICLES, ABANDONED AUTOMOBILES. It shall be unlawful to abandon any
automobile or recreational vehicle as defined in Section 5 406.01 on the Municipal
Streets, highways, alleys, parks, or other property. An automobile or recreational
vehicle shall be deemed to be abandoned if left unattended: (1) with no current license
plates affixed thereto for more than six (6) hours on any public property; (2) for more
than twenty four (24) hours on any public property where parking is not legally
permitted; (3) for more than forty-eight (48) hours in a seventy-two (72) hour period if
left on a portion of public property on which parking is legally permitted; or(4) for more
than twenty four (24) hours on private property if left initially without the permission of
the owner, or after the permission of the owner shall have been terminated.
08-105 MUNICIPAL PROPERTY AND RIGHT OF WAY; OBSTRUCTIONS: It shall be
(B) unlawful for any person, persons, firm, corporation or other entity to place or cause to
be placed any fence, gate, building, structure, sign, banner, vending machine or other
obstruction on any sidewalks, alleys, streets, or any other public property or public
right-of-way;
I have sent a letter to the current tenets asking that they remedy the complaint, but, since you are
the homeowner, I am also sending you a copy of the letter.
What this means is that the golf cart needs to be removed from the right-of-way (ROW). The
vehicles can be legally parked in their spots for no more than 48 hours in a 72-hour period.
However, the bigger problem is that the vehicles, as parked now, create an obstacle for any
vehicle trying to access the ROW. If the vehicles were parked facing either east or west, it should
solved the problem of anyone trying to access the ROW. Please see the enclosed photos.
On Monday, Jan. 11; the above property wilt be inspected to assure the violation has been
corrected/removed. If, following the inspection, it is determined that the violation still exists, you
