BLAIR, NE 68008
RE: 1311 Prospect Ave
Dear Mr. Borges and others:
This is a courtesy letter to notify you that we have received a complaint regarding the right-of-way
(ROW) being blocked by a golf cart and vehicles on the south side of the property located at the
above address. This is a violation of the following municipal codes:
Code Description
05-411 VEHICLES, ABANDONED AUTOMOBILES. It shall be unlawful to abandon any
automobile or recreational vehicle as defined in Section 5 406.01 on the Municipal
Streets, highways, alleys, parks, or other property. An automobile or recreational
vehicle shall be deemed to be abandoned if left unattended: (1) with no current license
plates affixed thereto for more than six (6) hours on any public property; (2) for more
than twenty four (24) hours on any public property where parking is not legally
permitted; (3) for more than forty-eight (48) hours in a seventy-two (72) hour period if
left on a portion of public property on which parking is legally permitted; or(4) for more
than twenty four (24) hours on private property if left initially without the permission of
the owner, or after the permission of the owner shall have been terminated.
08-105 MUNICIPAL PROPERTY AND RIGHT OF WAY; OBSTRUCTIONS: It shall be
(B) unlawful for any person, persons, firm, corporation or other entity to place or cause to
be placed any fence, gate, building, structure, sign, banner, vending machine or other
obstruction on any sidewalks, alleys, streets, or any other public property or public
rig ht-of-way;
What this means is that the golf cart needs to be removed from the right-of-way (ROW). The
vehicles can be legally parked in their spots for no more than 48 hours in a 72-hour period.
However, the bigger problem is that the vehicles, as parked now, create an obstacle for any
vehicle trying to access the ROW. If the vehicles were parked facing either east or west, it should
solved the problem of anyone trying to access the ROW. Please see the enclosed photos.
On Monday, Jan. 11, the above property will be inspected to assure the violation has been
corrected /removed. If, following the inspection, it is determined that the violation still exists, you
will receive a formal notice to correct/remove the violation within five (5) days of the date of the
formal notice as per city code. If an extension is needed for additional time to comply with this
-- request, please contact City Hall at (402) 426-6688.
