Form ownumz ~, ` �iliii� 1��!''�_�!''�:� 31311/ �- 3�1►11 Il THIS AGREEMENT entered into and between the City of Blair, Nebraska, hereinafter referred to as "City ", and I t hereinafter referred to as "Tow Company." _ f A WHEREAS, City desires to have Tow Company provide towing services to City of vehicles from city jurisdiction towed and impounded at the request of the City of Blair Police Department, Washington County Sheriff, and Nebraska State Patrol , and WHEREAS, Tow Company desires to provide towing and storage services to City and is in the business of operating and managing a business for such purpose. NOW, THEREFORE, in consideration of the mutual covenants and promises of the parties and other valuable consideration, it is hereby agreed by and between the parties as follows: 1. Nonexclusive Agreement Towing Company agrees and understands that this Agreement is nonexclusive in nature and that City, on its own or by and through the Washington County Sheriff Dispatch, may contract with any other towing company for all or any portion of the towing service required by City. Towing Company agrees and understands that City, in its sole and absolute discretion, may utilize the services of Towing Company from time to time, but this Agreement in no way requires City to utilize the services of Towing Company. 2. Duties of Towing Company Towing Company agrees to comply with the following duties: (A) On -Call Status Towing Company agrees to maintain a 24 -hour per day telephonic answering service and further agrees to respond within 20 minutes of any telephonic request for services by City or the Washington County Sheriff Dispatch on behalf of City; (B) Towing Service Towing Company agrees that it has adequate towing equipment and expertise to tow and transport motor vehicles in a safe and workmanlike manner; (C) Storage Facility Towing Company agrees that it will tow all vehicles in the city's jurisdiction ordered to be towed by the Blair Police Department, Washington County Sheriff, and Nebraska State Patrol to the City Impound Lot located at 850 East Fairview Drive, and agrees to secure any motor vehicles towed pursuant to this Agreement and to protect said motor vehicles from theft, collision, fire or damage during towing operation. 3. Indemnification Towing Company does hereby indemnify and hold City harmless from any claim, expense, damage, or cause of action which may arise out of any loss, damage or injury arising out of any towing service provided by Towing Company pursuant to the terms of this Agreement. Said indemnification to include but not be limited to any theft, collision, fire, vandalism, or damage occasioned during the period of time in which Towing Company has possession and custody of such motor vehicle, and any contents or articles left in such motor vehicle. 4. Liability Insurance Towing Company shall provide to City a Certificate of Insurance in form satisfactory to City, demonstrating that Towing Company has in existence general liability coverage to provide insurance coverage for the towing operation for the services provided pursuant to the terms of this Agreement; provided, further, that adequate insurance shall be an amount not less than $500,000.00 per occurrence and at least $50,000.00 coverage for each automobile towed pursuant to this Agreement; provided, further, said Certificate of Insurance shall name the City of Blair as an additional insured. 5. Compensation Towing Company shall be compensated as follows: The City shall pay Towing Company $50.00 per tow ordered by the Blair Police Department, Washington County Sheriff, or Nebraska State Patrol from anywhere in the city's jurisdiction to the City Impound Lot. In the case of tows ordered as a result of an accident, the city may reimburse Towing Company a reasonable rate for accident cleanup and miscellaneous costs. Towing Company shall submit a bill to the Blair Chief of Police by the 5' of each month and shall receive payment following approval of claims by the Blair City Council. 6. Independent Contractor Towing Company agrees and acknowledges that it is an independent contractor and is not an agent, representative or employee of City. 7. Termination of Agreement Either party may terminate this Agreement by giving seven (7) days written notice of termination to the other party and thereafter this Agreement shall automatically terminate. The reason for the updated agreement is that now tow companies will be required to tow vehicles to the newly established city impound lot. The towing agreement outlines the rights and responsibilities of the towing company, and provides more detailed information on the impound lot. Please review the enclosed agreement. He towed a car from an accident scene at Boomgards to Dillon Chevrolet. He charged $150.00. Both Dillon and Hipnar tow felt this was too high. I explained that towing from accident scene was not part of our contract towing. They just wanted us to be aware of possible overcharging by a City subcontractor. The towing company is AT&T Towing in Kennard. He was told to file a complaint against this towing company so they could not be used as a city approved towing company because he was not careful with his vehicle. They hooked up the wrecker to his car and cracked the windshield, then placed the towed vehicle in a ravine on AT &T's property.
