About Fence, LLC (herein after AF) agrees to furnish fence materials ( Fence ") to the undersigned ( "Customer") for the property described herein in accordance with the Plat and
all terms
set forth herein. Customer hereby authorizes AF to Install all materials on said property as provided. Customer hereby understands this contract is an estimate of total footage:
actual
footage will be determined after final measurement when property pins are located and the actual total purchase price of the fence will be based upon the final measurement. Any
changes made after the date of this contract will be in form of a Change Order and charged accordingly. Customer agrees to pay $150.00 for each approved CHANGE ORDER request
applicable. if a waiver of survey exists, the Customer hereby assumes full responsibility and cost for the location of the property line upon which the fence is to be installed.
Customer
acknowledges that AR will Install the footings for the fence on the property line as located by Customer, not the actual fence itself. Customer agrees to defend, hold harmless
and
Indemnify AF from and against all claims, liabilities and expense for injury, death or damage to persons, property, trespass and all other damage or loss arising out of or after
the
installation or location ° of the fence, unless such damage or loss is a result of the gross negligence of AF. Customer agrees to pay 60% of the total contract price upon signature
/acceptance
( "Deposit"), which shall become a contract after signature of the customer is received by AF. The remaining balance Is due on date of completion. Customer may not withhold any
payment as a result of repair or adjustments. A service charge of 1,5% per month, 18% per annum will apply to delinquent accounts not paid within 5 days of date of Invoice. All legal
and related fees accrued in an effort to collect on this account for whatever reason will be the responsibility of the customer. This contract also includes placement of AF signs.
Should the
Customer remove these signs, it voids any and all warranties on said fence. Customer also agrees to reimburse AF for all required permits. If Customer terminates this Agreement (for
any
reason) prior to completion of the work described herein, AF will be entitled to retain 15% of the total contract price plus the cost of materials and labor actually incurred as
liquidated
damages, in addition to any other rights and remedies available under applicable law. AF reserves the right to make additional charges to the Customer in the event of unusual ground
conditions, such as rock formations which might impede the installation. Such additional charges shall be based on actual additional labor required to complete installation under
the
circumstances. Customer understands and agrees to the terms and that AF IS NOT RESPONSIBLE FOR ANY SPRINKLER DAMAGE.
