FINAL NOTICE
Deal- X4s, Gerke:
My name is Adam Tripp, City Attorney for the City of Blair. I have reviewed your letter dated
November 17, 2012 to City Administrator, Rod Storm, regarding the above-described property.
After meeting with District Court staff and reviewing the official court file in Cl 12 145, it does
not appear that there are any pending Court matters that Would prohibit you from addressing the
concerns of the City of Blair.
As you are aware, the City of Blair is very concerned with the condition of the property and
demands that action be taken immediately. It appears that you have been unable or unwilling to
take the steps needed to remedy this situation. This clean -up must include the overgrown
vegetation, metal stored on the site, concrete retaining blocks stored on site and the volunteer
trees growing on the partially constructed retaining wall. The construction of the wall is
incomplete and the building permit obtained is no longer valid. In addition, citizen complaints
have continued regarding the unacceptable appearance of the property. We formally demand that
the property is cleaned up within thirty (30) days of this letter.
All issues regarding the property must be compliant with all applicable rules and
regulations of the City of Blair and the property cleared of all junk within thirty (30) days
or I am directed to seek an Order through the Washington County Court System it would allow
the City of Blair to force these actions in the interests of the safety and quality of life of the
community. I would seek all costs associated with the action, the clean-up as well as litigation
costs and attorney fees.
Please contact Rod Storm, City Administrator, if You need clarification on the steps you Must
take to rectify the situation within thirty (30) days. If I do not receive confirmation that you have
taken the necessary measures to bring this property up to code or that the property is cleared I
will consider issuing a formal summons against NIOU Without any Further correspondence to you.
