COUNCIL MEMBER KEPHART INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDINANCE CREATING PAVING DISTRICT NO. 194 IN THE CITY OF BLAIR,
WASHINGTON COUNTY, NEBRASKA, DESCRIBING SAID STREET IMPROVEMENT
DISTRICT AND IMPROVEMENTS TO BE CONSTRUCTED THEREIN, AND PROVIDING
THAT SPECIAL ASSESSMENTS MAY BE LEVIED IN PROPORTION TO BENEFITS TO
THE PROPERTY IN SAID DISTRICT; AND PROVIDING FOR PUBLICATION OF THIS
ORDINANCE IN PAMPHLET FORM.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. Pursuant to Sections 16 -617, 16- 617.01, 16 -618, 16 -619 and 16 -620,
R.R.S. Neb. 1997, Paving District No. 194 be and the same is hereby created within the City of
Blair, Nebraska, the outer boundaries of which District shall encompass the following- described
properties together with the street described below upon which said properties abut, TO -WIT:
A TRACT OF LAND BEING DESCRIBED AS LOTS 86 AND 87 OF DEERFIELD
ADDITION COMMENCING AT THE SOUTHWEST CORNER OF LOT 86 OF SAID
DEERFIELD ADDITION; THENCE N31 °06'39 "E (ASSUMED BEARING) ON THE EAST
RIGHT OF WAY LINE OF DEERFIELD BOULEVARD, A DISTANCE OF 344.07 FEET TO
A POINT OF CURVATURE; THENCE CONTINUING ON SAID EAST RIGHT OF WAY
LINE NORTHEASTERLY ON A 350.00 FOOT RADIUS TANGENT CURVE TO THE LEFT,
AN ARC DISTANCE OF 122.20 FEET, THE CHORD OF SAID CURVE BEARS
N21 ° 12'04 "E, 121.58 FEET TO THE POINT OF BEGINNING; THENCE CONTINUING ON
SAID EAST RIGHT OF WAY LINE NORTHEASTERLY ON A 350.00 FOOT RADIUS
TANGENT CURVE TO THE LEFT, AN ARC DISTANCE OF 122.60 FEET, THE CHORD
OF SAID CURVE BEARS N01 °09'50 "E, 121.97 FEET TO THE SOUTHWEST CORNER OF
LOT 30, OF SAID DEERFIELD ADDITION; THENCE N80 0 09'44 "E ON THE SOUTH LINE
OF LOTS 30 THROUGH 33 OF SAID DEERFIELD ADDITION, A DISTANCE OF 328.23
FEET TO THE SOUTHWEST CORNER OF LOT 34 OF SAID DEERFIELD ADDITION;
THENCE N68 0 34'35 "E ON THESOUTH LINE OF SAID LOT 34 A DISTANCE OF 105.90
FEET TO THE SOUTHWEST CORNER OF LOT 35, OF SAID DEERFIELD ADDITION;
THENCE N63 0 31'50 "E ON THE SOUTH LINE OF SAID LOTS 35 AND 36, A DISTANCE
OF 154.04 FEET TO THE NORTHWEST CORNER OF LOT 42 OF SAID DEERFIELD
ADDITION; THENCE S43 0 40'38 "E ON THE WEST LINE OF LOTS 42 AND 43, OF SAID
DEERFIELD ADDITION, A DISTANCE OF 320.63 FEET TO THE WESTERLY LINE OF
OUTLOT 1 OF SAID DEERFIELD ADDITION; THENCE CONTINUING ON
THEWESTERLY LINE OF SAID OUTLOT 1 THE NEXT TWO COURSES: S06 0 40'49 "W, A
DISTANCE OF 269.07 FEET; S64 0 33'37 "W, A DISTANCE OF 425.14 FEET; THENCE
S42 0 57 1 22 11 W, A DISTANCE OF 322.17 FEET TO THE NORTHERLY RIGHT OF WAY
LINE OF U. S. HIGHWAY 75; THENCE N58 °50'00 "W ON SAID NORTHERLY RIGHT OF
WAY LINE, A DISTANCE OF 433.31 FEET TO THE POINT OF BEGINNING,
CONTAINING 11.84 ACRES, MORE OR LESS.
Within said District, the street to be improved and improvements to be included are:
Civic Drive east from Deerfield Boulevard approximately 60 lineal feet to a T-
intersection, extending south from the intersection approximately 120 lineal feet to the
limits of the Civic Drive right -of -way, and extended north and east from the intersection
approximately 480 linear feet to the limits of the Civic Drive right -of -way.
SECTION 2. The improvements to be constructed in Paving District No. 194 shall include
grading, paving, curbing, guttering, storm sewer and other necessary or incidental appurtenances
to the improvements. Paving will consist of 25 feet wide by 7 inches thick Portland Cement
Concrete.
SECTION 3. All of said improvements shall be constructed to the established grades as
fixed by ordinance of said City and shall be constructed in accordance with plans and
specifications to be approved by the City Council. Said improvements in Paving District No.
194 shall be made at public cost, and the cost of such improvements, excepting street
intersections, may be assessed against the property within said District specially benefited
thereby, in proportion to such benefits.
SECTION 4. That this ordinance shall be known as Ordinance No. 2281 and shall be in
effect from and after its passage, approval and publication according to law.
