COUNCIL MEMBER WOLFF INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDINANCE VACATING A PORTION OF THE RIGHT -OF -WAY ALONG 16 STREET
BETWEEN NEBRASKA AND PARK STREETS IN THE CITY OF BLAIR, WASHINGTON
COUNTY, NEBRASKA, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FULL
FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA, AS FOLLOWS:
SECTION 1. That the east side of 16 Street between Nebraska and Park Streets has excess
right -of -way that is not necessary for the needs of the City of Blair. As a result, the area consisting
of the east twenty -seven feet (27') of the 16 Street right -of -way from Nebraska Street to Park Street
is hereby vacated and the ownership of the same, pursuant to Neb. Rev. Stat. 16 -611, shall revert to
the owners of the adjacent real estate known as Tax Lot 251 and SW RR ROW, Section 12,
Township 18N, Range 11 E, Blair City and City Park in Block 9, Section 12, Township 18N, Range
11 E, Blair City, all in Washington County, Nebraska. However, the City of Blair shall retain a utility
easement over the vacated areas in order to construct, repair and maintain any and all utilities
including but not limited to water, storm sewer, sanitary sewer, electric, natural gas, telephone, cable
television, etc.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. This ordinance shall be in full force and effect from and following the passage
and publication hereof as required by law.
