AN ORDINANCE AMENDING SECTION 501.04 AND SECTION 303 OF THE GENERAL AGRICULTURAL DISTRICT OF ORDINANCE NO. 1798 OF THE COMPREHENSIVE ZONING REGULATIONS FOR THE CITY OF BLAIR, NEBRASKA TO ALLOW A CONSTRUCTION YARD AS AN EXCEPTION SUBJECT TO THE ISSUANCE OF A CONDITIONAL USE PERMIT AND PROVIDING A DEFINITION OF CONSTRUCTION YARD; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA, AS FOLLOWS: SECTION 1. Section 501.04 of "Exceptions" of the Comprehensive Zoning Ordinance is amended to add the following exception: "(19) Contractor yards." SECTION 2. Section 303 "Definitions" of the Comprehensive Zoning Ordinance is amended to add the following definition: "(43.1) Contractor Yard: Buildings and premises where contractor firm stores its equipment, vehicles, tools and inventory. In addition, a business office for the firm and repairs and maintenance of the firm's equipment and vehicles may occur on site if conducted entirely within an enclosed structure." SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. MINES, MAYOR Amendment to 501.04 AGG General Agricultural District of Ordinance No. 1798 Contractor Yard as a Conditional Use Mayor Mines and the Blair City Council: Please consider the following questions/points before making your_ decision: 1. The following uses for the property are already allowed with a Conditional Use permit (see Page 37): Farm Equipment Service/Repair; Salvage Yard; Dirt, soil, sand, gravel and rock borrow pits and processing sites; Sewage. Treatment Plant; Commercial Auction Yards and Barns, etc. Is a Contractor Yard any worse? 2. Not all, but a portion of our business is based upon agriculturally related services, which is an accepted use under the General Ag Ordinance. 3. Why are there four other Contractor Yards on property zoned AGG within a half -mile radius of the proposed property? (Henton Trenching, Shepard Excavating, Camden Excavating, Washington County Yard) 4. Note that there were no individuals (including over 18 neighbors/property owners) present at the Planning Commission meetings (two meetings held) to contest the use of the property for a Contractor Yard. 5. If the Contractor Yard amendment is accepted, it may set a precedent, however, a Conditional Use permit must still be obtained which can be issued for a limited amount of time. After that time, if it is found that a Contractor Yard is not the ideal use for the property, it is the Planning Commission's prerogative to reject future Conditional Use Permit applications.
