DECLARATION AS TO USE
COUNCIL MEMBER KEPHART INTRODUCED THE FOLLOWING RESOLUTION:
WHEREAS, THE City of Blair is the owner of a portion of the Northeast Quarter Section of
Section 7, Township 18 North, Range 12 East of the Sixth Principal Meridian, a portion of the
Southwest Quarter Section of Section 5, Township 1.8 North, Range 12 East of the Sixth
Principal Meridian, and the Southeast Quarter Section of Section 6, Township 18 North, Range
12 East of the Sixth Principal Meridian, Washington County, Nebraska, and
WHEREAS, said portion of the Northeast Quarter of Section 7, Township 18 North, Range 12
East of the Sixth Principal Meridian, Washington County, Nebraska, is now being occupied by
Fairview Drive, a Local City Street, and
WHEREAS, said portion of the Southwest Quarter of Section 5, and the Southeast Quarter
Section of Section 6, Township 18 North, Range 12 East of the Sixth Principal Meridian,
Washington County, Nebraska is now being occupied by Optimist Park, a City Park, and
WHEREAS, The City of Blair hereby wished to construct, operate, and maintain a
Walking /Hiking Trail, and associated appurtenances, across a portion of said property, and
WHEREAS, The trail connector, and associated appurtenances, is to be construction as part of
Nebraska Department of Roads project ENH- 89(30), Control Number 22549, and identified as
Blair Connector Trails Project, and
WHEREAS, To comply with Federal Highway Administration23 CFR 1.23(a) "Interest to be
acquired — The State shall acquire rights -of -way of such nature and extent as are adequate for the
construction, operation and maintenance of a project "; It is necessary for the City of Blair to
declare that a portion of said property shall be used for the construction, operation and
maintenance, for a period of no less than twenty five years from the completion of its
construction, and
NOW THEREFORE, BE IT RESOLVED, THAT THE Mayor and City Council of the City of
Blair, Nebraska, hereby approves the use of a portion of said land owned by the City of Blair for
the construction, operation and maintenance of a Walking /Hiking Trail, and associated
appurtenances, as shown on attached Exhibit "A ", and as aligned in project plans and
specifications for Nebraska Department of Roads project ENH - 89(30), Control Number 22549,
and identified as Blair Connector Trails, for a period of no less than twenty five years from the
completion of its construction.
COUNCIL MEMBER KEPHART MOVED THAT THE RESOLUTION BE ADOPTED AS
READ, WHICH SAID MOTION WAS SECONDED BY COUNCIL MEMBER ANDERSEN.
UPON ROLL CALL, COUNCIL MEMBERS STEWART, SHEPARD, KEPHART, WILLIS,
ANDERSEN, WOLFF AND JENSEN VOTING "AYE" AND COUNCIL MEMBERS NONE
VOTING "NAY ", THE MAYOR DECLARED THE FOREGOING RESOLUTION PASSED
AND APPROVED THIS 13TH DAY OF JANUARY, 2015.
