Wiese, hereinafter referred to as "Wiese" and the City of Blair, Nebraska, hereinafter referred to as "City". Whereas, Wiese will be obtaining a building permit from the City for the purpose of constructing a new residence on the real estate descrilled above. However, a residential structure currently exists on the above property zoned AGG (General Agricultural District). Whereas, the City Zoning Regulations DO NOT allow for a second dwelling on the real estate indicated above and the issuance of a building permit would make the existing residence a non - conforming use. I Therefore, the parties hereby agree and stipulate as follows: 1. That when a building permit is issued by the City to construct a new residential structure on the above property, the existing structure will remain on the property to be used for storage and a habitable living space that can only be used by friends and/or family. Under no circumstances can the existing structure be rented or used as a second living residence or a primary residence of anyone. 2. This agreement will be filed with the Washington County Register of Deeds confirming this second residence is NOT to be used as habitable living space on a permanent or rental basis and Wiese agrees to not sell or advertise the existing structure as a rental facility or second living residence on the above property. 3. Wiese, his successors and assigns acknowledge that any inclusion of this facility as a second dwelling will be a direct violation of the City of Blair Zoning Ordinance and subject to any and all legal ramifications. 4.
