COUNCIL MEMBER HALL INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDINANCE DECLARING THAT AN EMERGENCY EXISTS TO CITY PROPERTY AND
AUTHORIZING THE CITY OF BLAIR TO WAIVE THE ADVERTISEMENT OF BIDS, THE
PREPARATION OF ESTIMATES, AND ALLOWING STAFF TO NEGOTIATE AND ENTER
INTO CONTRACTS ON ALL ROOF REPAIR, WINDOW REPAIR, AND AIR CONDITIONING
UNIT REPAIR WITH TO THE APPROVAL BY THE MAYOR BASED ON
RECOMMENDATION OF THE EMC INSURANCE ADJUSTER AND HGM TO EXPEDIATE
REPAIR IN ORDER TO AVOID ADDITIONAL LOSS AND DAMAGE TO HEALTH AND
PROPERTY PURSUANT TO NEBRASKA REVISED STATUTE § 16- 321(6); AND PROVIDING
FOR PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA AS FOLLOWS:
SECTION 1. The Mayor and City Council declare an emergency exists from significant
damage caused by the hail storm in June 2014.
SECTION 2. In order to avoid additional significant damage to public property and health
that would result if repairs are not completed before winter, the Mayor and the City Council waive
the advertisement of bids, preparation of estimates and allow city staff to negotiate and enter into
contracts on all roof repair, window repair and air conditioner repair with the approval of the Mayor
after consultation with the EMC Insurance adjuster and HGM pursuant to Nebraska Revised Statute
§ 16- 321(6) which states in part "In case of a public emergency resulting from infectious or
contagious diseases, destructive windstorms, floods, snow, war, or an exigency or pressing necessity
or unforeseen need calling for immediate action or remedy to prevent a serious loss of, or serious
injury or damage to, life, health, or property, estimates of costs and advertising for bids may be
waived in the emergency ordinance when adopted by a three - fourths vote of the council and entered
of record."
SECTION 3. This ordinance shall be effective from and after its passage and publication as
provided by law.
SECTION 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed.
