Release of All Claims - CulvertRELEASE OF ALL CLAIMS
The undersigned authorized representative of Union Pacific Railroad, here referred to as
Releasor, does hereby release, acquit and forever discharge Releasee, City of Blair, Nebraska
and all persons and entities associated with City of Blair, Nebraska, from any and all actions,
causes of action, claims, injuries to personnel, demands, damages, costs, loss of services,
equipment repair, expenses and compensation on account of, or in any way growing out of the
use of the culvert, at or near Fish Creek and Marina Drive in Blair, Washington County,
Nebraska.
Releasor declares and represents that if said culvert should fail, that the Union Pacific Railroad
shall be further responsible for immediately removing any obstruction or blockage of Fish Creek
that shall be caused through the use of the crossing and culvert by Union Pacific Railroad.
Releasor further declares and represents that if such blockage or obstruction is created that the
necessary debris removal shall be immediately made at the sole expense of Union Pacific
Railroad. The Union Pacific Railroad further agree and warrant that Union Pacific Railroad will
at all times maintain Fish creek crossing so that in no way the public can access the Fish Creek
crossing.
This release contains the entire agreement between and among the parties hereto, and the terms
of this release are contractual and not a mere recital.
I, the undersigned, have carefully read the foregoing release and know and understand the
contents thereof. I sign this release voluntarily as my own free act with full knowledge of its
significance, intending to be legally bound thereby.
