Enclosed is the Highly Erodible Land and Wetland Conservation
Determination Form SCS -CPA -026 for your farm. This determination
is part of the conservation provisions of the Food Security Act
of 1985, as amended, and was made in response to your application
for USDA program benefits.
Field numbers listed in item 8 and 9 of the form SCS- CPA -026, and
shown on the enclosed map, have been classified as highly
erodible under the current definition. In order to maintain USDA
program eligibility, you will need to farm these fields in
accordance with a conservation plan.
Items 11 through 26 of the form describe any wetlands found on
your farm. Please note the conditions under which these areas
may or may not be farmed, and contact your local SCS office if
you have any questions. If you plan to maintain, improve, or
install a drainage system, you should notify your local SCS
office well in advance of your plan to alter a wet area so the
alteration can be done with full knowledge of its potential
effect on your USDA program eligibility.
In addition, I must advise you that construction activities
(especially filling) in or near wetlands, lakes, rivers, or
streams may be regulated by the U.S. Army Corps of Engineers
through Section 404 of the Clean Water Act. The Corps should be
consulted prior to any construction in those areas for a
determination of their permit requirements.
If you do not agree with this determination you may request a
reconsideration within 15 days of this decision. Your request
should be made in writing to the above office address and should
state the reason for the request for reconsideration.

to the wetland conservation provisions.
15. Minimal Effect Wetlands (MW). These wetlands are to be farmed aeeordiing to the rr&&r al- effect agreement signed
at the time the minimal -effect determination was made.
16. Mitigation Wetlands (MIW). Wetlands on which a person is actively mitigating a frequently cropped area or a wetland
converted between December 23, 1985 and November 28, 1990.
17. Restoration with Violation (RVW- year). A restored wetland that was in violation as a result of conversion after
November 28, 1990, or the planting of an agricultural commodity or forage crop.
18. Restoration without Violation (RSW). A restored wetland converted between December 23, 1985 and
November 28, 1990, on which an agricultural commodity has not been plante&
19. Replacement Wetlands (RPW). Wetlands which are converted for purposes other#mn to increase production,
where the wetland values are being replaced at a second site.
20. Good Faith Wetlands (GFW +year). Wetlands on which ASCS has dellernwted a err, to be in good faint and the
wetland has been restored.
21. Converted Wetlands (CW). Wetlands converted after December 23,1985 and prior to November 28,1990. In any
year that an agricultural commodity is planted on these Converted Wedands, you wig be ineligble for USDA benefits.
