This agreement made this 22nd day of April, 1997, by and between the City of Blair,
Nebraska, a Municipal Corporation, hereinafter referred to as "Seller ", and Marvin A. Daniels,
hereinafter referred to as "Buyer."
WITNESSETH:
Blair agrees to sell and convey to Marvin A. Daniels by Warranty Deed, free and clear of
all encumbrances except easements and restrictions of record, the following described real estate
(hereinafter referred to as "Parcel No. 1 "), to wit:
Part of Tax Lot 64 lying in the SW1 /4 of the SWIA of Section 1, Township 18
North, Range 11 East of the 6 Principal Meridian, Washington County, Nebraska and
more particularly described as follows:
From the southeast corner of Tax Lot 37 in Section 1, Township 18 North, Range
11 East; Thence N 89 °56'00 "W (Assumed Bearing) along the south line of Said Tax Lot
37 and Tax Lot 63 in said Section 1 a distance of 180.00 feet to the southeast corner of
Tax Lot 61 in said Section 1; thence N 00 °18'41" along the east line of Tax Lots 61 and
62 in said Section 1 a distance of 549.17 feet to the Point Of Beginning; thence
continuing N 00 °18'41" W along the east line of said Tax Lot 62 and its northerly
projection a distance of 99.22 feet; thence S 89 °58'08" E a distance of 180.38 feet to the
west line of lot 20 in Ridgeview Estates Addition to the City of Blair as said addition is
surveyed, platted and recorded in the Washington County Courthouse; thence S 00 °18'15"
E along said west line a distance of 20.00 feet to the northeast corner of Tax Lot 54 in
said Section 1; thence N 89 °58'08" W along the north line of said Tax Lot 54 a distance of
155.90 feet to the northwest corner of said Tax Lot 54; thence S 00 0 1820" E along the
west line of said Tax Lot 54 a distance of 79.08 feet; thence S 89 °41'45" W a distance of
24.47 feet to the Point Of Beginning and containing 0.13 Acres, more or less. (5,545
Square Feet) AND:
All of Tax Lot 63 and part of Tax Lot 64 all lying in the SWIA SW1 /4 of Section
1, Township 18 North, Range 11 East of the 6' Principal Meridian, Washington County,
Nebraska and more particularly described as follows:
From the southeast corner of Tax Lot 37 in Section 1, Township 18 North, Range
11 East; thence N 89 °56'00" W (Assumed Bearing) along the south line of said Tax Lot
37 a distance of 155.59 feet to the southwest corner of said Tax Lot 37 and the Point Of
Beginning; thence continuing N 89 °56'00" W along the westerly projection of said south
line a distance of 24.41 feet to the southeast corner of Tax Lot 61 in said Section 1;
thence N 00 °18'41" W along the east line of Tax Lots 61 and 62 in said Section 1 a
distance of 499.17 feet; thence N 89 °41'45" E a distance of 24.46 feet to a point on the
west line of Tax Lot 54 in said Section 1; thence S 00 °1820" E along the west line of Tax
Lots 54, 53 and 37 in said Section 1 a distance of 499.33 feet to the Point of Beginning

and said Buyer agrees to purchase said property on the following terms and conditions, to -wit:
The considerations therefore shall be that Marvin A. Daniels will deed or cause to have
conveyed to the City of Blair, by warranty deed good and fee simple marketable title, free and
clear of all encumbrances except easements and restrictions of record, the following described
real estate ( hereinafter referred to as "Parcel No. 2 "), to -wit:
Part of Tax Lot 54 lying in the SWl /4 SW1 /4 of Section 1, Township 18 North,
Range 11 East of the 6 "' Principal Meridian, Washington County, Nebraska and more
particularly described as follows:
From the southeast corner of Tax Lot 37 in said Section 1, T 18 N, R 11 E and
assuming the south line of said Tax Lot to bear N 89 °56'00" W; thence N 00'1611 " W
along the east line of Tax Lots 37, 53 and 54 in said Section 1 a distance of 489.57 feet to
the northwest corner of Lot 18 in Ridgeview Estate Addition to the City of Blair,
Nebraska, as said addition is surveyed, platted and recorded in Washington County
Courthouse and point lying on a 225.00 foot radius curve to the left; thence westerly
along said 225.00 foot radius curve an are distance of 69.89 feet to the point of tangency,
said curve having a chord bearing of N °81 2421 "W and chord distance of 69.61 feet;
thence S 89 °41'45" W a distance of 87.12 feet to a point on the east line of Tax Lot 64 in
said Section 1; thence N 00 °18'20" W along said east line a distance of 50.00 feet; thence
N 89 °41'45" E a distance of 87.12 feet to a point of curvature; thence along a 275.00 foot
radius curve to the right an arc distance of 69.51 feet to the southwest corner of Lot 20 in
Ridgeview Estates Addition; thence S 00 °18'15" E a distance of 52.03 feet to the Point of
Beginning and containing 0.18 Acres, more or less. (7,840 Square Feet)
Closing of the transaction shall be on or before forty -five (45) days following passage of
an ordinance by the City of Blair approving the sale herein.
It is understood and agreed by and between the parties hereto they shall receive
possession of the premises they are to receive upon closing.
Blair shall not be responsible for payment of any real estate taxes assessed against Parcel
No. 2. The Buyer shall be responsible for and shall pay any and all real estate taxes assessed
against Parcel No. 2, including but not limited to any assessments made for any year or partial
year during which the City owned the premises, but which are levied as a result of this
transaction.
The City will obtain and cause to be installed as part of the Sewer Improvement District
in the Korshoj Development by Dana College, a sewer extension to the boundary of Tax Lot 53
owned by the Buyer.
The City will cooperate with the Buyer in grading the hill immediately on the north side
of Tax Lot 54 to blend in with the adjacent properties.
The Buyer hereby specifically acknowledges a portion of the premises being conveyed to
him from the City of Blair, which is a portion of Tract A may contain unbuildable areas as a
result of certain debris being placed thereon in the past. The Buyer hereby releases the City from
any liability or responsibility for such debris.
This agreement shall be subject to the filing of any remonstrance pursuant to Nebraska
Statutes against the exchange of this property by Blair wherein such remonstrance would be
deemed to be valid and which would prohibit, pursuant to the statutes of the State of Nebraska,
the conveyance of the property by the City of Blair.
This agreement executed the dated first aforesaid shall be binding upon the assigns and
successors of all parties hereto.

I have consulted with Marvin Daniels and Doris Detjens on what we
discussed in the City Chambers the other day.
Marvin Daniels is willing to trade a portion of his land for a street to cross
as you requested in the conference in return for the following:
1. That the entire City right of way from Adams Street to twenty feet
North of the end of Marvin Daniels properties except for what would be street
right of way would become the property of Marvin Daniels.
2 , arvin would receive the twenty feet immediately adjacent on the
North of his property known as Tax Lot 54 out of what is now Tax Lot 64 or part
of the former City dump. This would of course be subject to his not being able to
build on the 20' or place any improvement on those properties except the
possibility of some utility easements.
3 _ Marvin would pay for one -half of the street, water and sewer
assessments crossing his property described as Tax Lot 54,
4. Marvin would able to obtain a sewer and water line to his Tax Lot
53 from the street mproved by Dana College on what is known as the Kors of
property.
