2106ORDINANCE NO. 2106 COUNCIL MEMBER FANOELE INTRODUCED THE FOLLOWING ORDINANCE: AN ORDINANCE OF THE CITY OF BLAIR, NEBRASKA, CREATING STORM WATER SEWER DISTRICT NO. 1; DECLARING THE ADVISABILITY AND NECESSITY OF CONSTRUCTING A STORM SEWER; DESCRIBING SAID STORM SEWER AND THE LOCATION AND TERMINAL POINTS THEREOF; REFERRING TO PLANS, SPECIFICATIONS AND ESTIMATE OF COST FOR SAID IMPROVEMENTS. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA: Section 1. The Mayor and Council of the City of Blair, Nebraska, deem and hereby declare it advisable and necessary to build a storm sewer within the City as hereinafter provided and further find that said storm sewer will constitute a public improvement in said City which may properly be financed by issuance of the City's Storm Water Sewer District Bonds pursuant to Section 16- 672.11, R.R.S. Neb. 1997, as amended. Section 2. There is hereby created in the City of Blair, Nebraska, a storm sewer district to be known and designated as Storm Water Sewer District No. 1, the outer boundaries of which shall encompass the following described real estate, together with the streets upon which said properties directly abut, to -wit: SOUTH VIEW SUBDIVISION (Lots 1 through 10 inclusive), being a plat of all of Tax Lot 213 and that part of vacated 13th Avenue lying adjacent to Tax Lot 213 and all lying in Section 13, Township 18 North, Range 11 East of the 6th P.M., Washington County, Nebraska (more particularly described as follows: Beginning at an iron found at the Southwest Corner of Tax Lot 213, said point being the Southeast Corner of Tax Lot 79, all in Section 13, Township 18 North, Range 11 East; thence N 00 °00'00" E (assumed bearing) along the westerly line of said Tax Lot 213, easterly line of said Tax Lot 79, a distance of 650.13 feet to an iron found at the Northwest Corner of said Tax Lot 213; thence continuing N 00 °00'00" E along the easterly line of said Tax Lot 79 a distance of 50.00 feet to a point 50.00 feet southerly of the Southwest Corner of Tax Lot 223 in said Section 13; thence S 89°53'15" E parallel to and 50.00 feet southerly of the southerly line of said Tax Lot 223 a distance of 141.41 feet to a point 50.00 feet westerly of the westerly line of Tax Lot 224 in said Section 13; thence S 00 °07'27" W parallel to and 50.00 feet westerly of said westerly tax lot line a distance of 50.00 feet to a point on the northerly line of said Tax Lot 213; thence S 89°53'15" E along said northerly tax lot line a distance of 167.41 feet to the Northeast Corner of said Tax Lot 213; thence S 00 °03' 15" W along the easterly line of said Tax Lot 213 a distance of 649.95 feet to the Southeast Corner of said Tax Lot 213; thence N 89 °55' 12" W along the southerly line of said Tax Lot 213 a distance of 308.10 feet to the Point of Beginning and containing 4.76 acres, more or less). all of said property being within the corporate limits of the City of Blair, Nebraska, or within two miles beyond its corporate limits Section 3. The storm sewer shall be constructed in said District in accordance with plans and specifications prepared by the City Engineer for the City of Blair, Nebraska. Reference is hereby made to said plans and specifications which have been filed with the City Clerk of the City of Blair prior to the introduction and proposing of this Ordinance and which are hereby approved by the Mayor and City Council. Section 4. The size, kind, location and terminal points of said storm sewer shall be as follows: A 18 inch and 24 inch storm water sewer in the right of way of 13 Avenue commencing at the intersection of Wilbur Street and 13 Avenue running thence south into Southview Subdivision within said 13 Avenue right of way and ending in the cul -de -sac of 13 Avenue as located in Southview Subdivision. Section 5. The City Engineer's estimate of the total construction cost for improvements in said district, which has been filed with the City Clerk prior to the introduction and proposing of this Ordinance, is $143,969.18. Section 6. To pay the costs of the improvements herein provided for, the Mayor and Council will, after such improvements have been completed and accepted by the City, cause to be issued the negotiable bonds of the City, all as provided by Sections 16- 672.01 to 16- 672.11, R.R.S. Neb. 1997, as amended. The cost of such improvements shall be assessed against the property within said District specially benefited thereby, in proportion to such benefits as determined by the Mayor and Council of the City. Section 7. This Ordinance shall be in full force and effect from and after its passage and approval as provided by law. Passed and approved this 24th day of April, 2007. ATTEST: o B `1 NDA R.
