This agreement is entered into on May 24, 2010 by and between Norman Lee Kyle Jr.
and Kristen I. Kyle, husband and wife, hereinafter referred to as "Kyle's" and the City of Blair,
Nebraska, hereinafter referred to as "City ".
LEGAL DESCRIPTION: Lot 4, Oak Park 1, Block 3, Washington County, Nebraska.
ADDRESS: 11302 Rambleridge Drive
Whereas, the City of Blair has executed a release document filed with the Washington
County Register of Deeds office relating to this property; and
Whereas, the Kyle's have been presented with and are in acknowledgement of the
property maintenance report that is attached to this agreement regarding the above property;
and
Whereas, this agreement will be filed with the Washington County Register of Deeds
Office and be made part of the permanent record relating to this property; and
Whereas, the Kyle's agree to work with the City of Blair after they obtain possession of
the property to bring the existing residential structure into compliance with the 2009
International Property Maintenance Code on or before October 1, 2010; and
Whereas, the Kyle's further agree to obtain any and all required permits for this project;
and
Whereas, the Kyles further understand that as part of the permit process they must
register with the City of Blair as a "General Contractor" or enter into an agreement with a
"General Contractor" that is registered with the City of Blair and that all sub contractors
performing work shall be registered or licensed by the City of Blair as required; and
Whereas, a final inspection must be obtained from the City of Blair Building Inspector
prior to any occupancy, transfer and/or change of ownership.
Now therefore it is agreed by all parties that:
1. Prior to any work commencing on this property the Kyle's shall:
a). Obtain a building permit for all work to be preformed.
b). Submit a full soils investigation report prepared by a Nebraska Licensed Engineer.
c). Submit a set of construction plans prepared by a Nebraska Licensed Engineer.
d). Submit a plot plan with construction plans for review of zoning setbacks.
2. That all work shall be completed by October 1, 2010. Recorded

3. No occupancy shall be granted until the City of Blair Building inspector and the Nebraska
Licensed Engineer that designed and sealed the plans have both signed off that the
construction has been completed per the plans and specifications.
4. This agreement is only valid contingent upon all parties having a financial interest in this
project, including any and all financial institutions, have signed this agreement acknowledging
their full and complete understanding.
5. That all parties agree and understand that should the cost of construction make the
repair infeasible, that it is the responsibility of the Kyle's to remove all structures, including
concrete slabs, footings, etc. and to stabilize the property with vegetative cover by November
15, 2010,
This Agreement shall be binding upon and inure to the benefit of the parties hereto,
their successors and assigns.

Dear Ms. Thiel,
The following information from the 2006 International Residential Code has been provided by City
Building Inspector, Howard Wolfe regarding the above stated property.
R 104.1 The Building Official is authorized to enforce the code (IRC 2006) j
R 104.4 The Building Official is authorized to make inspections or accept reports from
approved agencies or individuals.
R 106.1 Where special conditions exist, the Building Official has the authority to require the
construction plans to be prepared by a design professional (Engineer, Architect, etc.)
Based on this information, Building Inspector Wolfe is requiring 1) a soils investigation report
prepared by an Engineer licensed in Nebraska, 2) Structural Engineer report with engineered
construction plans from an Engineer licensed in Nebraska, and 3) a plot plan in order to review the
construction plans for code conformance.
Prior to any work being done, plans and a permit application are required to be submitted to the City
of Blair for approval. Once a permit has been issued, the City of Blair will release the "Notice of
Violation" that is currently on record against the deed at the Washington County Register of Deed's
office.
