2007-01COUNCIL MEMBER ABBOTT INTRODUCED THE FOLLOWING RESOLUTION: WHEREAS the City of Blair, Nebraska, has been presented with an Interlocal Agreement between the City of Blair, Nebraska, and the Village of Herman, Nebraska, providing for a dog impoundment agreement, a copy of said Agreement being attached hereto, marked Exhibit "A" and incorporated by this reference herein; and, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA, that the Interlocal Agreement attached hereto, marked Exhibit "A" and by this reference made a part of hereof as though fully set forth herein is hereby approved by the City of Blair, Nebraska. BE IT FURTHER RESOLVED THAT THE MAYOR AND CITY CLERK OF THE CITY OF BLAIR, NEBRASKA, are hereby authorized to execute and deliver, on behalf of the City of Blair, Nebraska, any documents that may be necessary for approval of said agreement. WHEELER, hereby certifies that she is the duly appointed, qualified and acting City Clerk of the City of Blair, Nebraska, and that the above and foregoing Resolution was passed and adopted at a regular meeting of the Mayor and City Council of said City held on the 9th day of January, 2007. WHEELER, CITY CLERK INTERLOCAL AGREEMENT THIS AGREEMENT made and entered into this 6 3 day of January, 2007 by and between the Village of Herman, Nebraska, a Village, (Herman), and the City of Blair, Nebraska, a City of the First Class, (Blair). WITNESSETH: Whereas, the parties hereto find it to be their mutual advantage to cooperate in the impoundment, boarding and disposition of dogs running at large which are originally captured within the corporate city limits of Herman; and Whereas, Herman and Blair are authorized by law to regulate the running at large of dogs, and to provide for their impoundment and disposition under the provisions of respectively, Neb. Rev. Stat. 17 -547 and 17 -548, and Neb. Rev. Stat. 16 -235 and 16 -236 of the Revised Statutes of Nebraska, 1943; and Whereas, the parties are authorized to join together cooperatively under the terms of the Interlocal Cooperation Act, that being Neb. Rev. Stat. 23 -2201 et. seq, and amendments thereto; and Whereas, it is to the mutual advantage of the parties hereto that a written agreement be entered into providing for the impoundment, boarding and disposition of such dogs. NOW THEREFORE, IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS: 1. Boarding and impound Fees: a. That the impound fee payable to Blair shall be twenty dollars ($20.00) per dog, this is a one time fee to cover the cost of processing the delivery of the animal and shall be payable by Herman to Blair. b. That the boarding fee for each dog impounded shall be ten dollars ($10.00) per day for a minimum period of three (3) days and a maximum period of seven (7) days unless a longer stay is required by Nebraska Law payable by Herman to Blair. c. The City of Blair will bill on a monthly basis for all impound and boarding fees. 2. Services: That all dogs impounded shall be treated in a humane manner and shall be provided with a sufficient supply of food and water each day, and the facility constituting the animal shelter shall be maintained strictly in accordance with the law of this state. 3. Release of Dogs: That no dog shall be released or redeemed by its owner or person adopting the same, unless such party shall have a receipt from the Village of Herman for a dog license and /or for the impound and boarding fees. Proof of Rabies shots must be presented to the Village of Herman within seventy -two (72) hours of release. 4. Unclaimed Dogs: Any dog unclaimed after seven (7) days shall be transported by Blair, without additional transportation cost for Herman, to Thone Animal Clinic or Blair Small Animal Clinic, in Blair, Nebraska where it will be euthanized and disposed of in a humane manner or adopted out at the discretion of Blair. 5. Any sick, injured or vicious dog shall be immediately transported to Thone Animal Clinic or Blair Small Animal Clinic for treatment. If treatment is estimated to cost in excess of $50.00, said clinic shall contact Herman Village Clerk or his /her representative for authorization to treat. All costs shall be the cost of Herman. Herman shall either authorize the immediate euthanization and disposal of such dog or treatment. 6. Cost of Veterinary Services: That the cost of services provided by Thone Animal Clinic or Blair Small Animal Clinic for dogs impounded for Herman shall be the sole responsibility of Herman and will be billed directly to Herman, as set forth in paragraph 5 above. 7. Termination: This agreement shall continue in effect from year to year until terminated by the withdrawal of either Herman or Blair. Such withdrawal shall require reasonable written notice by either party, of not less than (10) days. 8. Transportation: Herman shall be responsible for transporting all animals to the City of Blair Jeanette Hunt Animal Shelter and in the case of a sick, injured or vicious dog to Thone Animal Clinic or Blair Small Animal Clinic for treatment. . - 9' - - Date Date City of Blair, Nebraska uthoYized Representative Village of Herman, Nebraska uthoriz Representative
