2101ORDINANCE NO2101 COUNCIL MEMBER ABBOTT INTRODUCED THE FOLLOWING ORDINANCE: AN ORDINANCE DESIGNATING THE JURISDICTION OF THE CITY OF BLAIR, NEBRASKA, OVER TERRITORY OUTSIDE OF ITS CORPORATE LIMITS UNDER SECTION 16 -901 R.R.S. NEB. ET SEQ. AND DESCRIBING SUCH TERRITORY BY METES AND BOUNDS DESCRIPTION, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA. SECTION 1. The City of Blair hereby exercises jurisdiction over territory outside of the corporate limits of the City of Blair under Section 16 -901 R.R.S. City of Blair Two Mile Extraterritorial Jurisdiction City Limits Existing Proposed EXTRACT OF MINUTES CITY OF BLAIR, NEBRASKA A meeting of the Mayor and Council of the City of Blair, Nebraska was convened in open and public session at 7:00 o'clock P.M. on March 13, 2007 at the City Council Chambers, 218 South 16 Street, Blair, Nebraska. Present were: Mayor Realph; Councilmembers: Stewart, Scheve, Shotwell, Fanoele, Christiansen, Wolff, Abbott and Biffar. Absent were: None. Notice of the meeting was given in advance thereof by publication, the City's designated method for giving notice, a copy of the Proof of Publication being attached to these Minutes. Notice of this meeting was given in advance to the Mayor and all members of the City Council and a copy of their Acknowledgment of Receipt of Notice and the agenda is attached to these Minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The Mayor publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy in the room where the meeting was being held. Whereupon, Councilmember Abbott introduced Ordinance No. 2101 entitled: "AN ORDINANCE OF THE CITY OF BLAIR, NEBRASKA, AUTHORIZING THE ISSUANCE AND SALE OF WATER SYSTEM REVENUE BOND ANTICIPATION NOTES OF THE CITY OF BLAIR, NEBRASKA, IN THE PRINCIPAL AMOUNT OF NOT TO EXCEED FIFTEEN MILLION DOLLARS ($15,000,000) FOR THE PURPOSE OF PROVIDING INTERIM FINANCING FOR THE COST OF EXTENDING, ENLARGING AND IMPROVING THE CITY'S WATERWORKS PLANT AND SYSTEM PENDING THE ISSUANCE OF PERMANENT REVENUE BONDS OF THE CITY; PRESCRIBING THE FORM OF SAID NOTES; AGREEING TO ISSUE THE CITY'S WATER SYSTEM REVENUE BONDS TO PAY THE NOTES AT MATURITY OR TO PAY THE NOTES FROM OTHER AVAILABLE FUNDS; PROVIDING FOR A PLEDGE OF THE REVENUES OF THE WATER SYSTEM, JUNIOR AND SUBORDINATE TO THE PLEDGE OF REVENUES IN FAVOR OF THE CITY'S OUTSTANDING BONDS AND ADDITIONAL BONDS FROM TIME TO TIME ISSUED AND OUTSTANDING, FOR PAYMENT OF SUCH NOTES; ENTERING INTO A CONTRACT ON BEHALF OF THE CITY WITH THE HOLDERS OF SAID NOTES; AND PROVIDING FOR PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM." Said Ordinance was fully and distinctly read, and by motion of Councilmember Abbott, seconded by Councilmember Fanoele, it was designated as Ordinance No. 2102 and the title thereof was approved. The roll was called on the passage of said motion and the following voted "AYE ": Stewart, Scheve, Shotwell, Fanoele, Christiansen, Wolff, Abbott and Biffar. The following voted "NAY ": None. Councilmember Abbott moved that the statutory rule requiring ordinances to be fully and distinctly read on three different days be suspended, and such motion was seconded by Councilmember Fanoele. The roll was called and the following voted "AYE ": Stewart, Scheve, Shotwell, Fanoele, Christiansen, Wolff, Abbott and Biffar. The following voted "NAY ": None. The motion to suspend the statutory rule, having been concurred in by three - fourths of all members of the Council, was declared passed and adopted. Whereupon Ordinance No. 2102 was read by title and thereafter Councilmember Abbott moved for final passage of said Ordinance. Councilmember Fanoele seconded the motion. The Mayor stated: "The question is, shall Ordinance No. 2101 be passed and adopted ?" The roll was called and the following voted "AYE ": Stewart, Scheve, Shotwell, Fanoele, Christiansen, Wolff, Abbott and Biffar. The following voted "NAY ": None The passage and adoption of said Ordinance having been concurred with by a majority of all members elected to the Council, said Ordinance was by the Mayor declared passed and adopted, and the Mayor, in the presence of the Council, signed and approved said Ordinance, and the Clerk attested the passage and approval of the same and affixed the seal of the City thereto.
