2103ORDINANCE NO. 2103 AN ORDINANCE CREATING PAVING DISTRICT NO. 189 IN THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA, DESCRIBING SAID STREET IMPROVEMENT DISTRICT AND IMPROVEMENTS TO BE CONSTRUCTED THEREIN, AND PROVIDING THAT SPECIAL ASSESSMENTS MAY BE LEVIED IN PROPORTION TO BENEFITS TO THE PROPERTY IN SAID DISTRICT. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA: Section 1. Pursuant to Sections 16 -617, 16- 617.01, 16 -618, 16 -619 and 16 -620, R.R.S. Neb. 1997, Paving District No. 189 be and the same is hereby created within the City of Blair, Nebraska, the outer boundaries of which District shall encompass the following- described properties together with the street described below upon which said properties abut: SOUTH VIEW SUBDIVISION (Lots 1 through 10 inclusive), being a plat of all of Tax Lot 213 and that part of vacated 13th Avenue lying adjacent to Tax Lot 213 and all lying in Section 13, Township 18 North, Range 11 East of the 6th P.M., Washington County, Nebraska (more particularly described as follows: Beginning at an iron found at the Southwest Corner of Tax Lot 213, said point being the Southeast Corner of Tax Lot 79, all in Section 13, Township 18 North, Range 11 East; thence N 00 °00'00" E (assumed bearing) along the westerly line of said Tax Lot 213, easterly line of said Tax Lot 79, a distance of 650.13 feet to an iron found at the Northwest Corner of said Tax Lot 213; thence continuing N 00 °00'00" E along the easterly line of said Tax Lot 79 a distance of 50.00 feet to a point 50.00 feet southerly of the Southwest Corner of Tax Lot 223 in said Section 13; thence S 89°53'15" E parallel to and 50.00 feet southerly of the southerly line of said Tax Lot 223 a distance of 141.41 feet to a point 50.00 feet westerly of the westerly line of Tax Lot 224 in said Section 13; thence S 00 °07'27" W parallel to and 50.00 feet westerly of said westerly tax lot line a distance of 50.00 feet to a point on the northerly line of said Tax Lot 213; thence S 89°53'15" E along said northerly tax lot line a distance of 167.41 feet to the Northeast Corner of said Tax Lot 213; thence S 00 °03' 15" W along the easterly line of said Tax Lot 213 a distance of 649.95 feet to the Southeast Corner of said Tax Lot 213; thence N 89°55'12" W along the southerly line of said Tax Lot 213 a distance of 308.10 feet to the Point of Beginning and containing 4.76 acres, more or less). Within said District, the street to be improved and improvements to be included are: Section 2. The improvements to be constructed in Paving District No. 189 shall include grading, paving, curbing, guttering and other necessary or incidental appurtenances to the improvements. Paving will consist of 25 feet wide by 7 inches thick Portland Cement Concrete. Section 3. All of said improvements shall be constructed to the established grades as fixed by ordinance of said City and shall be constructed in accordance with plans and specifications to be approved by the City Council. Said improvements in Paving District No. 189 shall be made at public cost, and the cost of such improvements, excepting street intersections, shall be assessed against the property within said District specially benefited thereby, in proportion to such benefits. Section 4. That this ordinance shall be known as Ordinance No. 2103 and shall be in effect from and after its passage, approval and publication according to law. ATTEST: `-/A-41- BRENDA R. Also included is an unnamed street located at the north boundary of Southview Subdivision and running west from 13 Avenue for approximately 154 lineal feet.
