2100ORDINANCE NO. 2100 COUNCIL MEMBER ABBOTT INTRODUCED THE FOLLOWING ORDINANCE: AN ORDINANCE AMENDING SECTION 6 -315 AND 6 -316 OF THE MUNICIPAL CODE OF THE CITY OF BLAIR, NEBRASKA PERTAINING TO POSSESSION, TRANSPORTATION, WHEN ALLOWED OF FIREARMS AND HAND GUNS IN THE CITY OF BLAIR, NEBRASKA; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT. SECTION 1. Section 6 -315 of the Municipal Code of the City of Blair, Nebraska is hereby amended as follows, to -wit: "Sec. 6 -315 MISDEMEANORS; FIREARMS, POSSESSION TRANSPORTATION, WHEN ALLOWED. It shall be unlawful for any person, except an authorized law enforcement officer, or a private security guard who has been registered as such with the Chief of Police, purposely or knowingly to transport in any conveyance or in any other manner whatsoever, or to possess, off of his premises, any rifle, shotgun, air gun, air rifle, pellet gun, or `B -B" gun unless said firearm is unloaded. It shall be an affirmative defense that the defendant was engaged in any lawful business, calling, or employment at the time he or she was carrying any weapon or weapons and the circumstances in which such person was placed at the time were such as to justify a prudent person in carrying the weapon or weapons for the defense of his or her person, property, or family or the defendant was in compliance with all of the Nebraska Concealed Weapons Permit requirements." SECTION 2. Section 6 -316 of the Municipal Code of the City of Blair, Nebraska is hereby amended as follows, to -wit: "Sec. 6 -316 MISDEMEANORS; HAND GUNS, POSSESSION, TRANSPORTATION, WHEN ALLOWED. It shall be unlawful for any person, except an authorized law enforcement officer, or a private security guard who has been registered as such with the Chief of Police, purposely or knowingly, to transport in any conveyance or in any other manner whatsoever any hand gun unless said hand gun is unloaded and contained in an enclosed gun case or unloaded and broken down. The carrying of any such firearm in a holster type gun 1 case without further breaking down said fire arm shall not be deemed to be in compliance with the requirements of this Section. It shall be an affirmative defense that the defendant was engaged in any lawful business, calling, or employment at the time he or she was carrying any weapon or weapons and the circumstances in which such person was placed at the time were such as to justify a prudent person in carrying the weapon or weapons for the defense of his or her person, property, or family or the defendant was in compliance with all of the Nebraska Concealed Weapons Permit requirements." SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. This ordinance shall be in full force and effect from and following the passage and publication hereof as required by law. Passed and approved this 23rd day of January, 2007.
