2006-38RESOLUTION NO. 2006 -38
COUNCILMEMBER FANOELE INTRODUCED THE FOLLOWING RESOLUTION:
WHEREAS, the City of Blair, Nebraska, passed Ordinance No. 2081 creating Street
Improvement District No. 188 which said notice of creation was first published On August 15,
2006 in The Enterprise, a legal newspaper published and of general circulation in the City,
WHEREAS, the Clerk mailed "Notices of Creation" to all affected property owners in such
district on August 9, 2006,
WHEREAS, the Clerk reported that written objections of property owners had been filed in
her office within the twenty -day period following the first publication of the Notice of Creation of
Street Improvement District No. 188. The Clerk further reported that an examination of the
records in the office of the Registrar of Deeds of Washington County and of the appropriate plat or
map of the properties and street within said District revealed the following:
Total front footage of directly abutting property within
Paving District No. 188:
Total front footage represented by owners objecting:

NOW THEREFORE BE IT RESOLVED that the Mayor and City Council of the City of
Blair, Nebraska, hereby find and determine that:
Objections filed against the improvements within Street Improvement District No. 188 did
not represent a majority of the front footage of property directly abutting on the streets or
alleys to be improved within said District and that said improvements shall be constructed.
COUNCILMEMBER ABBOTT MOVED THAT THE RESOLUTION BE ADOPTED AS
READ, WHICH SAID MOTION WAS SECONDED BY COUNCILMEMBER WOLFF. UPON
ROLL CALL, COUNCILMEMBERS STEWART, SCHEVE, SHOTWELL, ABBOTT,
FANOELE, MCMANIGAL, WOLFF AND BIFFAR VOTING "AYE ", AND
COUNCILMEMBERS NONE VOTING "NAY ", THE MAYOR DECLARED THE
FOREGOING RESOLUTION PASSED AND APPROVED THIS 7TH DAY OF SEPTEMBER,
2006.
