Said owners further hereby specifically agree that said waiver is not a permanent waiver, and that if the public street, road, or highway is surfaced with asphalt or concrete and the property is then located in the city limits of Blair or is annexed by the City of Blair, the applicant and his/her heirs and assigns agree to pave the driveway within 90 days of being notified to do so. In all situations, if the public street, road, or highway is hard surfaced, the portion of the driveway in the public right -of -way must be paved. The driveway shall be paved with not less than 4 inches of asphalt or concrete. The owners hereby specifically agree that this agreement shall constitute a covenant which shall run with the land, and that upon the filing of this agreement against the real estate described hereinabove, all successors, assigns, or transferees shall be bound by the terms and conditions of this agreement as though an original parry hereto. This agreement shall be binding upon the heirs, personal representatives, successors, and assigns of the undersigned. Dated: zti 17 , 2013.
