2071ORDINANCE NO. 2071 AN ORDINANCE CREATING SANITARY SEWER EXTENSION DISTRICT NO. 69 OF THE CITY OF BLAIR, NEBRASKA; ESTABLISHING THE OUTER BOUNDARIES OF SAID DISTRICT; DESIGNATING THE SIZE, LOCATION, AND TERMINAL POINTS OF THE SANITARY SEWER LINES FOR SAID DISTRICT; AND REFERRING TO PLANS AND SPECIFICATIONS AND ESTIMATE OF THE ENGINEER IN CONNECTION THEREWITH ON FILE WITH THE CITY CLERK; PROVIDING FOR SUBSEQUENT AMENDMENT TO THIS ORDINANCE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA. SECTION 1. The Mayor and Council of the City of Blair, Nebraska, hereby find and determine that it is necessary and advisable to extend the municipal sanitary system beyond the existing system by the construction of sanitary sewer improvements pursuant to the authority granted by Section 19 -2402 R. R. S. Neb. 1997, as amended; that there is hereby created Sanitary Sewer Extension District No. 69; that said sanitary sewer extension shall commence at the existing sanitary sewer end at 2915 Highway 30; that none of the properties located within the Sanitary Sewer Extension District hereby created are presently served by the City's existing system of sanitary sewer service; and that all property within said District is either within the corporate limits of the City of Blair or within two miles beyond such corporate limits; that the improvements needed to provide sanitary sewer service for the area within the Sanitary Sewer Extension District hereby created will consist of both local area sanitary sewer service lines (the "Local Sewer Lines ") and an outfall sanitary sewer line, pump station and sanitary sewer force main (together, the "District -Wide Improvements ") required to provide service to the entire Sanitary Sewer Extension District hereby created; that both the Local Sewer Lines and the District -Wide Improvements will provide special benefits to the property within the District. SECTION 2. The outer boundaries of Sanitary Sewer Extension District No. 69 shall include the following described real estate, together with the streets and roads upon which said properties directly abut, to -wit: A tract of land described as beginning at the intersection of Highway 30 and County Road 26 thence southwest along the Eastern border of Tax Lot 47 located in Section 27, Township 18 North, Range 11 East of the 6th P.M., in Washington County, thence Westerly along the Southern border of said Tax Lot 47 to the Southwest comer of said Tax Lot 47, thence North along the Western border of said Tax Lot 47 to the Southern edge of County Road 26, thence West along the South side of said County Road 26 to the Union Pacific railroad right of way to the east of the section line of Section 22, Township 18 North, Range 11 East of the 6 P.M. in Washington County, thence Northeasterly along the eastern edge of said railroad right of way to the 1 /2 section line of said Section 22, thence East along said 1/2 section line of said Section 22 to the Northwest corner of Tax Lot 18 located in said Section 22, thence South along the Western border of said Tax Lot 18 to the Southwest comer of said Tax Lot 18, thence East along the Southern border of said Tax Lot 18 to the Southeast comer of said Tax Lot 18, thence South along the West side of County Road 31 to the point of beginning, which area includes Tax Lots 2, 3, 4, 13 & 19 located in the South 1/2 of Section 22, Township 18 North, Range 11 East of the 6th P.M., in Washington County, Nebraska; and Lots 1 through 31 in the Southern Ridge Plat, Washington County; and Tax Lot 47 located in Section 27, Township 18 North, Range 11 East of the 6th P.M., in Washington County, Nebraska. SECTION 3. Sanitary Sewer Outfall and Sanitary Pump Station. The following proposed improvements, referred to herein as "Sanitary Sewer Outfall and Sanitary Pump Station ", shall constitute the District Wide Improvements: A. The size, location, and terminal points of the proposed Sanitary Sewer Outfall and Sanitary Pump Station improvements for Sanitary Sewer Extension District No. 69 are described as follows: Size and Type of Material: (1) 8 -inch PVC pipe with 54 -inch pre -cast manholes; (2) The pump station will consist of wet well made of reinforced lined pre -cast concrete manhole 10 -feet wide and 12 -feet deep, a pump station pump and controls and an emergency power supply; (3) 6 -inch PVC force main. Location and Terminal Points: (1) 8 -inch sewer line running from the existing sanitary sewer end at 2915 Highway 30, then southwesterly along the west side of Highway 30 to the Northwest comer of Highway 30 and County Road 26; (2) 8 -inch sewer line running from the West side of the Southern Ridge plat Westerly to the new pump station; (3) The pump station will be located in the Southwest comer of the Sanitary Sewer Extension District hereby created, which location is at a point approximately 1550 feet East of the Southwest comer of the Sanitary Sewer Extension District hereby created thence North approximately 400 feet; (4) 6 -inch force main running from the newly constructed pump station southerly to County Road 26 then easterly in County Road 26 to Highway 30 and the newly extended gravity sewer. B. A more detailed description of the proposed Sanitary Sewer Outfall and Sanitary Pump Station improvements is shown on the plans and specifications on file at the office of the City Clerk, City Hall, City of Blair, 218 South 16th Street, Blair, Nebraska 68008, to which reference is hereby made. C. Special assessments are proposed to be made for the Sanitary Sewer Outfall and Sanitary Pump Station improvements against all property located within the outer boundaries of the Sanitary Sewer Extension District No. 69. D. The engineers' estimate of total construction cost for the proposed Sanitary Sewer Outfall and Sanitary Pump Station improvements as heretofore filed with the City Clerk is $382,940.25. SECTION 4. Sanitary Sewer Phase I. The following proposed improvements, referred to herein as "Sanitary Sewer Phase I ", shall constitute the initial Local Sewer Lines: A. The size, location, and terminal points of the proposed Sanitary Sewer Phase I improvements for Sanitary Sewer Extension District No. 69 are described as follows: Size and Type of Material: 8 -inch PVC pipe and 54 -inch concrete pre -cast manholes and 6 -inch PVC pipe connecting to each lot. Location and Terminal Points: From the Eastern end of Ravae Lane Westerly and around the are of Ravae Lane to the intersection of Ravae Lane and County Road No. 26 and then Southeasterly across County Road No. 26 to the Northwest corner of Tax Lot 47 located in Section 27, Township 18 North, Range 11 East of the 6th P.M.; from the intersection of Sunset Circle and Ravae Lane Westerly between Lots 17 and 18 to the outfall sewer; and Northeasterly between Lots 23 and 24 from Ravae Lane to the Northern border of the Southern Ridge plat and then Westerly to the outfall sewer. B. A more detailed description of the proposed Sanitary Sewer Phase I improvements is shown on the plans and specifications on file at the office of the City Clerk, City Hall, City of Blair, 218 South 16th Street, Blair, Nebraska 68008, to which reference is hereby made. C. The outer boundary of the area for which special assessments are proposed to be made for the Sanitary Sewer Phase I improvements is the same as the outer boundaries of the Southern Ridge Plat and Tax Lot 47 located in Section 27, Township 18 North, Range 11 East of the 6th P.M., all of which property is located within the outer boundaries of Sanitary Sewer Extension District No. 69. D. The engineers' estimate of total construction cost for the proposed Sanitary Sewer Phase I improvements as heretofore filed with the City Clerk is $114,589.65. SECTION 5. This ordinance may be amended in order to provide for future sanitary sewer improvements as Local Sewer Lines within Sanitary Sewer Extension District No. 69 and special assessments for such future improvements may be levied against such property located within said district which is benefited by such improvements; any special assessments levied within the district for District -Wide Improvements may be allocated and reallocated to future subdivided lots within Sanitary Sewer Extension District No. 69 by the Mayor and Council the extent permitted by law and as determined appropriate from time to time. SECTION 6. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7.
