2240ORDINANCE NO. 2240 COUNCIL MEMBER RYAN INTRODUCED THE FOLLOWING ORDINANCE: "AN ORDINANCE OF THE CITY OF BLAIR, NEBRASKA, AMENDING ORDINANCE NO. 2224 OF THE CITY TO INCREASE THE AGGREGATE AMOUNT OF WATER SYSTEM REVENUE BOND ANTICIPATION NOTES AUTHORIZED UNDER ORDINANCE NO. 2224 FROM $8,000,000 TO $8,200,000 AND OTHERWISE AFFIRMING AND RATIFYING SAID ORDINANCE NO. 2224 AND PROVIDING FOR PUBLICATION OF THIS AMENDING ORDINANCE IN PAMPHLET FORM." BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: Section 1. The Mayor and Council of the City of Blair (the "City ") hereby find and determines as follows: (a) the City owns and operates its own waterworks plant and system (the "Water System "), which constitutes a revenue- producing undertaking of the City; (b) that pursuant to Ordinance No. 2224 of the City, the City has authorized the issuance of up to $8,000,000 aggregate principal amount of Water System Revenue Bond Anticipation Notes, in one or more series (the "Notes ") in order to finance the costs of enlarging, expanding and improving the City's Water System by construction of expansions, enlargements and improvements (the "Project ") to the Water System, and particularly expansions, enlargements and improvements to the City's water treatment plant; (c) that to date the City has issued $5,000,000 of Notes; (d) that updated estimates of the cost of the Project are higher than initially estimated and stated in Ordinance No. 2224 and based upon updated estimate furnished by the City's engineer, the remaining cost of completion the Project may result in the need to issue additional Notes in a rinc1 ai amount exceeding $3,000,000; p" p (e) that in order to retain the ability to finance the increased costs of the Project through the issuance of Notes the City desires to increase the aggregate principal amount of Notes authorized to be issued under Ordinance No. 2224; Section 2. Section 2 of Ordinance No. 2224 is hereby amended to increase the aggregate principal amount of Notes authorized to be issued to finance costs of the project from $8,000,000 to $8 Section 3. As amended by this Ordinance, the City Council hereby ratifies and affirms Ordinance No. 2224 in its entirety. Section 4. The Mayor, Clerk, Treasurer and City Administrator of the City are hereby authorized to do all things and execute all such documents as may by them be deemed necessary and proper to complete the issuance and sale of the Notes as contemplated by Ordinance No. 2224, as amended by this Ordinance. This Ordinance is hereby determined to be a measure necessary to carry out the City's contractual obligations relating to the issuance of the Notes and the payment for the Project and shall take effect as provided by law. This Ordinance is hereby determined to be an emergency measure necessary to take effect to allow the City to borrow funds and finance the Project as intended in Ordinance No. 2224 and shall take effect immediately upon proclamation by the Mayor. Section 5. If any section, paragraph, clause, or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance. Section 6. All ordinances, resolutions or orders, or parts thereof, in conflict with the provisions of this ordinance are to the extent of said conflict hereby repealed. Section 7. This ordinance shall be published in pamphlet form and shall be in full force and effect from and after its passage as provided by law. PASSED AND APPROVED this 26 day of February, 2013.
