HA NDICAP i, ; , 1!• r This Easement Agreement ("Agreement) is made on + 2 - 1 , 2012 by and between of Eastern Nebraska Human Services Agency, Blair, Nebraska, hereinafter referred to as "Grantees ", and the City of Blair, Nebraska, hereinafter referred to as "City ". WHEREAS, the City has approved the construction and installation of a landing and ramp extending onto the Grantees' property into the front yard setback of 25', which is required by the City of Blair Zoning Ordinance, for use by residents of the property legally known as: LOT 10, NORTHVIEW ADDITION, BLAIR CITY, WASHINGTON COUNTY, NEBRASKA (809 N 13 STREET). WHEREAS, the construction of this ramp does not comply with current zoning regulations for front yard setback requirements, the City extends to the Grantees an easement for the purpose of allowing construction and installation of a landing and ramp into the city's required front yard setback and waiving the front yard setback requirements for such construction; and, WHEREAS, such construction does comply with code requirements for ADA and the International Building Code and the appropriate building permit has been obtained from the City; NOW THEREFORE FOR CONSIDERATION, receipt of which is hereby acknowledged, the parties hereto agree as follows: 1) Grant of Easement: The City hereby grants and conveys unto the Grantees a revocable' easement waiving the front yard setback requirements for the purpose of constructing, installing, maintaining and repairing a landing and ramp for use by residents of this property.
