1: Union Pacific Railroad Company is aDelaware corporation doing business in
the State of Nebraska.
2. Effective February 1, 1998, Defendant Union Pacific Railroad Company, a
Utah corporation, merged into Southern Pacific Transportation Company, a Delaware corporation,
and simultaneously therewith Southern Pacific Transportation Company changed its riame to Union
Pacific Railroad Company.
3. Union Pacific Railroad Company claims no eight, title or interest in or to the
real property which is described in the Amended Complaint as the subject matter thereof ("Subject
