2011-05-10 Animal Shelter dog runContract This contract and agreement made and entered into this day of May, 2011, by and between the City of Blair ( "Owner "), and Eriksen Construction Inc. ( "Contractor "). WITNESSETH: That the Contractor, for and in consideration of the lump sum of Seventy Seven Thousand Dollars and no cents ($77,000.00) payable as set forth in this Contract, hereby agrees to perform in accordance with the plans specifications attached for the various items of work awarded said Contractor on May 10, 2011 for the addition of dog runs at the City of Blair Jeanette Hunt Animal Shelter located at 147 South 4th Street, Blair, Washington County, Nebraska. That for good and valuable consideration and the mutual promises herein, the parties agrees as follows: 1. That it is mutually agreed by the parties hereto, that the Contractor's proposal, all project specifications and special provisions, and all supplemental agreements are a part of this Contract, and incorporated herein. 2. The Contractor expressly warrants that it has employed no third person to solicit or obtain this Contract in its behalf, or to cause or procure the same to be obtained upon compensation in any way contingent in whole or in part, upon such procurement, and that it has not paid, or promised or agreed to pay, to any third person in consideration of such procurement, or in compensation for services in connection herewith, any brokerage, commission, or percentage upon the amount to be received by it hereunder, and that it has not, in estimating the contract price demanded by it, included any sum by reason of any such brokerage, commission, or percentage, and that all moneys payable to it hereunder are free from obligation of any other person for services rendered, or supposed to have been rendered, in the procurement of this Contract. Contractor further agrees that any breach of this warrant shall constitute adequate cause or the annulment of this Contract by the Owner and that the said Owner may retain for its own use, from any sums due or to become due hereunder, an amount equal to any brokerage, commission, or percentage so paid. or agreed to be paid. 3. All work required in carrying out this Contract should be performed in compliance with the laws of the State of Nebraska. 4. Contractor states and agrees that it is complying with and will continue to comply with Fair Labor Standards in the pursuit of its business, and in the execution of this Contract. 5. That Contractor further agrees to pay all just claims for materials, supplies, tools, fuels, lubricants, equipment, equipment rental, machinery, insurance premiums and services used or consumed in the performance of the work by it or any of its sub - contractors, and for the payment of all laborers and mechanics for all; labor performed in the work by it or any of its sub- contractors, and for all other just claims filed against it or any of its sub- contractors in carrying out the provisions of this Contract. 6. Contractor agrees to provide one year warranty on workmanship and all labor and materials per the bid notice attached hereto and incorporated herein. 7. Contractor shall be eligible for progress payments monthly, as approved by Owner, and that prior to the final 30 per cent of the contract being paid out the Contractor shall furnish the City with lien wavers for all equipment and labor per the specifications. 8. The Contractor further agrees to perform the work under the direct supervision of the Owner or its representative and in accordance with the laws of the State of Nebraska. 9. The Contractor agrees to commence construction on the project within thirty (3 0) days of this Contract and to complete the project within one - hundred twenty (120) calendar days from the commencement of construction. 10. That in consideration of the foregoing, Owner hereby agrees to pay the Contractor promptly the amounts set forth herein, subject to the conditions set for the in this Contract or any part thereof as herein described. 11. It is further understood and agreed that the Contractor shall not do any work or furnish any materials not covered and authorized by this Contract, unless ordered in writing by the Owner. Any such work may be done or any such materials which may be furnished by the Contractor without such written order first being given, shall be at its own risk, cost and expense; and the Contractor hereby covenants and agrees that it shall make no claim for compensation for any work so done or any materials so furnished. 12. Contractor agrees to procure and maintain continuously during the entire term of this Contract, a policy or policies of commercial general liability insurance from a company or companies acceptable to Owner, at Contractor's own cost and expense, insuring Owner and Contractor from all claims, demands or actions; such policy or policies shall in addition to insuring Contractor protect and name the Owner and Owner's managing agent as additional Insured's and shall provide coverage in a combined single limit per occurrence of at least $100,000.00 for claims, demands or actions for bodily injury, death or property damage, or worker's compensation made by or on behalf of any person or persons, firm or corporation arising from, related to, or connected with the conduct and operation of Contractor's business in the Property, or arising out of and connected with the use and occupancy of the Real Estate by the Contractor. All such insurance shall provide that Owner shall be given a 2 minimum of ten (10) days notice by the insurance company prior to cancellation, termination or change of such insurance. Contractor shall provide Owner with copies of the policies or certificates evidencing that such insurance in full force and effect and stating the term and provisions thereof. 13. This Contract cannot be assigned by Contractor without the prior written consent of the Owner. 14. This Contract shall be binding upon and insure to the benefit of the parties hereto, their successors and assigns. 15. If any provision of this Contract is invalid or unenforceable to any extent, then that provision and the remainder of this Contract shall continue in effect and be enforceable to the fullest extent permitted by law. The trench drain shall be an ACO "Klassik Drain" system, Model #K100S or approved equal. Drain shall incorporate a 4" wide fiberglass trench that shall be of the required length shown on plans. Drain outlet pipe connection shall be 4 ". 2. Drain outlet shall connect to an integral catch basin Model #K -900 with lift -out plastic trash bucket. 3. Drain shall be a continuously sloped channel with a Type 495Q gray plastic ADA grate. 4. The drain shall have a foul odor trap at the outlet of the catch basin, and a cleanout where the 4" PVC Type DWV sewer line makes the 90 degree turn to run to the existing sewer piping at the far end of the existing building. 5.
