cn-2011-00060_0002 (2).tif 0 CN: -d li -- oov 6a h U I C1 C CONFIDENTIAL pure by nature To: Howard Wolfe, City Building Inspector Blair City Hall 218 South 16th Street Blair, Nebraska 68008 From: Vincent Mancini, Engineering Purac America P.O. Box 38 Blair, NE 68008 March 10, 2011 Re Stamped Drawing Issue — Nebraska Board of Engineers and Architects Title 110 Compliance Dear Mr. Wolfe; Claims for need of Nebraska stamped structural drawing package for temporary housing of engineering staff on PURAC America's lease of Cargill's Blair Manufacturing Plant are confusing based on recent discussions with Tyler Kohtz, Compliance Officer for the Nebraska Board of Engineers and Architects. According to Mr. Kohtz, Title 110 Paragraph 10.5.1 of the Nebraska Administrative Code is relevant to this discussion. His interpretation is that Nebraska Architectural stamps are not warranted for this temporary set of job trailers. 10.5 The Practice of Engineering and Architecture -The practice of engineering and architecture with reference to building projects: 10.5.1 The development and utilization of construction means and methods such as schedules, work plans, work orders and directions, procedures, construction calculations, selection, provision and use of temporary facilities in support of construction activities, reports, selection and use of safety procedures and facilities, instructions and similar items customarily used by contractors to implement construction work designed by licensed persons does not constitute the practice of engineering or architecture. In addition, these trailers where leased to Sutton Ethanol prior to being leased to PURAC America. Modcon, current owner of the units, installed, wired and plumbed the units for occupancy at the plant site in Sutton located in Butler County, Nebraska without the need for such paperwork. When we discussed the pamphlet statement, Mr. Kohtz recommended you discuss this issue directly with him for clarification. He can be reached at 402.471.2021. 1 understood that Nebraska Administrative Code affords you the right to demand such drawings and stamps if circumstances allow even with this exemption. 10.6 Building Officials — Not withstanding these exemptions, the responsible building official may require plans and specifications to be designed and prepared by an architect and /or professional engineer if the official finds a hazard to life, health, safety, or welfare due to the unusual circumstances of the building or structure or an unusually large number of potential occupants in relation to square footage for a particular occupancy.
