AGREEMENT
LEGAL DESCRIPTION: Tax Lot 9, Section 13, Township 18, Range 11 Blair, Washington
County, Nebraska.

ADDRESS: 715 S. 10 Street, Blair, Nebraska
This agreement is entered into on July 1, 2011 by and between Charles and Patti Butts,
husband and wife, hereinafter referred to as "Butts" and the City of Blair, Nebraska, hereinafter
referred to as "City ".
Whereas, Butts desire to continue to maintain an above ground swimming pool on their
property without any type of fence barrier, and

Whereas, the 2009 International Building Code states that where an above ground pool
structure is four foot or higher and used as a barrier or where the barrier is mounted on top of the
pool structure and the means of access is a ladder or steps, then the ladder or steps shall be
capable of being secured, locked or removed to prevent access, and
Whereas, it is the desire of the Butts to use the above ground pool of four foot or higher
as the barrier, they agree to secure, lock or remove the ladder or steps to prevent access to the
pool when not in use.
This Agreement shall be binding upon and inure to the benefit of the parties hereto, their
successors and assigns.
