Clarkson GrantRESOLUTION 2011 m 12 COUNCIL MEMBER STEWART INTRODUCED THE FOLLOWING RESOLUTION: WHEREAS the City of Blair, Nebraska, has been presented with an Interlocal Agreement between the City of Blair, Nebraska, and the City of Clarkson, Nebraska, to provide Responsible Charge (RC) services to manage a Safe Routes to School (SRTS) Grant in Clarkson, Nebraska; and WHEREAS, the terms and conditions thereof are acceptable to the municipality. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA, that the Interlocal Agreement attached hereto, marked Exhibit "A" and by this reference made a part of hereof as though fully set forth herein is hereby approved by the City of Blair, Nebraska. BE IT FURTHER RESOLVED THAT THE MAYOR AND CITY CLERK OF THE CITY OF BLAIR, NEBRASKA, are hereby authorized to execute and deliver, on behalf of the City of Blair, Nebraska, any documents that may be necessary for approval of said agreement. WHEELER, CITY CLERK INTERLOCAL COOPERATION AGREEMENT Project Number: SRTS- 19(11) Control Number 32188 THIS INTERLOCAL COOPERATION AGREEMENT is made and entered into this 12th day of April, 2011, by and between the City of Blair, Nebraska, a Nebraska Municipal Corporation, hereinafter referred to as "Blair" and the City of Clarkson, Nebraska, a Nebraska Municipal Corporation, hereinafter referred to as "Clarkson ", by and through their respective governing bodies authorized to execute same. WHEREAS, Nebraska Revised Statute §13-801 et. seq., R.R.S. 1943 (Reissue 2007), the "Nebraska Interlocal Cooperation Act" authorizes the parties hereto to unite their efforts and resources to make the most efficient use of their taxing authority and powers by enabling them to cooperate with other localities on the basis of mutual advantage, and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population and other facts influencing the needs and development of the parties hereto and to accomplish the intent of this agreement; and WHEREAS, the parties hereto desire to contract for services wherein Blair will provide services necessary to Clarkson to comply with Federal and State law requirements for a person of Responsible Charge (RC) as designated by the Nebraska Department of Roads (NDOR) and approved by the Federal Highway Administration (FHWA) to manage Safe Routes to School Grants obtained by Clarkson with said person of Responsible Charge providing services as required by NDOR and FHWA to obtain and comply with said grants. NOW, THEREFORE, in consideration of the foregoing recitals and following mutual covenants herein expressed, the parties agree as follows: Blair shall provide to Clarkson the services of a person of Responsible Charge (RC) as designated by the Nebraska Department of Roads (NDOR) and approved by the Federal Highway Administration (FHWA) to manage Safe Routes to School Grants, which grants are to be applied by Clarkson and under terms of application and governance as required by NDOR and FHWA. The Responsible Charge from Blair will be Allen Schoemaker, Director of Public Works of the City of Blair, Nebraska. The services to be included but not limited by this agreement shall be for the Blair person of RC to effectively manage the Safe Routes to School Grants through design, NEPA and construction for the City of Clarkson, Nebraska, and to provide all necessary documentation as required for the grants to be managed and to provide all necessary property and services necessary for the construction of the project. Blair shall be providing services only and the expense of Blair for services rendered to Clarkson shall be paid through the Grant by Clarkson, with billing to be consistent with Grant terms. It is anticipated that all Clarkson expenses due the City of Blair will be paid by or reimbursed from NDOR through the Grants. In the event that said funds are not reimbursed as anticipated, Clarkson shall still be obligated to reimburse Blair as noted above. Clarkson City of Clarkson- Blair - Interlocal Cooperation Agreement /If Work on the grants shall begin upon approval of this agreement by both parties and will terminate upon the conclusion of the work contemplated and covered by this Interlocal Cooperation Agreement and the Safe Routes to School Grants, as designated by NDOR and FHWA. Further, this Interlocal Cooperation Agreement may be terminated upon default of either party with a 7 day written notice to the Mayor or designated person of the other party. This Interlocal Cooperation Agreement may be ' terminated without default or cause, providing for a minimum of 30 day written notice. This agreement may be modified by the agreement of both parties hereto, in writing, to modify the services to be provided. A separate legal entity to conduct the joint or cooperative undertaking of this agreement shall not be established, and therefore the City Clerk of the City of Clarkson, Nebraska, and the Director of Public Works of the City of Blair, Nebraska, shall be jointly responsible for administrating the undertaking of this agreement.
