Quality Fence (herein after QFC) agrees to furnish fence materials ( "Fence ") to the undersigned ( "Customer") for the property described herein in accordance with the Plat and
all terms
set forth herein. Customer hereby authorizes QFC to install all materials on said property as provided. Customer hereby understands this contract Is an estimate of total footage:
actual
footage will be determined after final measurement when property pins are located and the actual total purchase price of the fence will be based upon the final measurement. Any
changes made after the date of this contract will be in form of a Change Order and charged accordingly. Customer agrees to pay $150.00 for each approved CHANGE ORDER request
applicable. Customer hereby assumes full responsibility and cost for the location of the property line upon which the fence is to be installed. Customer acknowledges that QFC will
install
the footings for the fence on the property line as located by Customer, not the actual fence itself. Customer agrees to defend, Bold harmless and Indemnify QFC from and agalrist
all
claims, Ilabilities and expense for injury, death or damage to persons, property, trespass and all other damage or loss out of or after the installation or location of the fence,
unless
such damage or loss is a result of the gross negligence of QFC. Customer agrees to pay 60% of the total contract price upon signature /acceptance ( "Deposit"), which shall become
a
contract after signature of the customer is received by QFC. The remaining balance is due on date of completion. Customer may not withhold any payment as a result of repair or
adjustments. A service charge of 1.5% per month, 1856 per annum will apply to delinquent accounts not paid within 5 days of date of invoice. All legal and related fees accrued in
an
effort to collect on this account for whatever reason will be the responsibility of the customer. This contract also includes placement of QFC signs. Should the Customer remove these
signs, it voids any and all warranties on said fence. Customer also agrees to reimburse QFC for all required permits. if Customer terminates this Agreement (for any reason) prior
to
completion of the work described herein, QFC will be entitled to retain 15% of the total contract price plus the cost of materials and labor actually incurred as liquidated damages,
in
addition to any other rights and remedies available under applicable law. QFC reserves the right to make additional charges to the Customer in the event of unusual ground conditions,
such as rock formations which might impede the installation. Such additional charges shall be based on actual additional labor requir d to complete installation under the circumstances.
Customer understands and agrees to the terms and that QFC IS NOT RESPONSIBLE FOR ANY SPRINKLER DAMAGE. 9V & woo q
