2011-08RESOLUTION NO. 2011-8 COUNCIL MEMBER STEWART INTRODUCED THE FOLLOWING RESOLUTION: WHEREAS, Section 5 -203 of the Municipal Code of the City of Blair provides that the governing body may, by resolution, designate certain streets in the municipality that commercial trucks shall travel upon and making it unlawful for persons operating such commercial trucks to travel upon any other streets other than those designated unless to pick up or deliver goods, wares, or merchandise. "Commercial Truck ", for the purposes of this resolution shall be defined as, "a motor vehicle weighing over 10,000 pounds, that is designed, used or maintained primarily for the transportation of property or persons for hire, compensation, or profit and is designated as a truck by the manufacturer ". WHEREAS, the safety and general welfare of the citizens of Blair require the restriction of commercial truck traffic to certain designated truck routes. WHEREAS, be it resolved by the Mayor and City Council of the City of Blair, that all State and Federal Highways within the city limits of the City of Blair, Nebraska are hereby designated as truck routes, and that pursuant to Section 5 -203 of the Municipal Code of the City of Blair it shall be unlawful for any person or persons to operate commercial trucks on any other streets other than those designated by this resolution as truck routes, except to pick up or deliver goods, wares, or merchandise and in that event the operator of such commercial truck shall return to said truck routes as soon as possible in traveling through or about the municipality. Commercial trucks that fall within the definition of this language which are lawfully parked at or near the owner or lessee's residence or in route directly to or from the owner or lessee's residence are excluded from enforcement under this section. Be it further resolved that the Director of Public Works is hereby directed to contact the Nebraska Department of Roads and notify them of the city's policy regarding truck routes requesting the posting of signs to reflect the same and that following the passage and publication of this resolution, it shall be unlawful for any person to fail, neglect or refuse to comply with the provisions of this resolution. COUNCIL MEMBER STEWART MOVED THAT THE RESOLUTION BE ADOPTED AS READ, WHICH SAID MOTION WAS SECONDED BY COUNCIL MEMBER WOLFF. UPON ROLL CALL, COUNCIL MEMBERS SHEPARD, STEWART, KEPHART, RYAN, CHRISTIANSEN, JENSEN, WOLFF AND HALL VOTING "AYE ", AND COUNCIL MEMBERS NONE VOTING "NAY", THE MAYOR DECLARED THE FOREGOING RESOLUTION PASSED AND ADOPTED THIS 22ND DAY OF MARCH, 2011.
