2197-FAILEDORDINANCE NO. 2197 COUNCIL MEMBER WOLFF INTRODUCED THE FOLLOWING ORDINANCE: AN ORDINANCE AMENDING CHAPTER 4 ARTICLE 5, SECTION 4 -507 OF THE MUNICIPAL CODE OF THE CITY OF BLAIR, NEBRASKA, BY ADDING PROVISIONS WHICH RELATE TO NUISANCE, ILLUMINATED, MOVING OR STROBE- EFFECT LIGHTED SIGN OR DISPLAY AS WELL AS PENALTIES RELATING THERETO AND AMENDING CERTAIN SECTIONS REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND PROVIDING FOR PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM. - BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: - SECTION 1. Chapter 4,•Article 5 of the Municipal Code of the City of Blair, Nebraska is hereby amended by adding Section 4 -507 in its entirety as follows: Sec. 4 -507 NUISANCES, ILLUMINATED, MOVING, RAPID FLASHING OR STROBE EFFECT LIGHTED SIGN OR DISPLAY. It shall be unlawful for any person, entity or business to create nuisance to the public by displaying, operating or illuminating any moving, rapid flashing, blinking, or strobe effect lighted sign or display that in any way endangers the public or any vehicle operating on or near any roadway by creating confusion and /or distraction to the public within the City of Blair during the hours of dusk until dawn. Any violation of this ordinance shall be a Class IV Misdemeanor and subject to a new violation every twenty -four (24) hours that each said violation occurs. Further, upon any subsequent conviction of this ordinance within any consecutive forty -eight (48) month period the Court may order such sign or display to cease to operate during the hours of dusk until dawn. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That this ordinance shall be in force and take effect from and after its passage, approval and publication as provided by law. PASSED AND APPROVED THIS 11TH DAY OF JANUARY, 2011.
