Pr - Scanned WASHJt Cc;jjN REGISTER OF D EED The undersigned, owner of the real estate described herein for and in consideration of One Dollar ($1.00) and other valuable consideration, mutual covenants and benefits to be derived therefrom, does hereby give, grant, sell and convey unto the City of Blair, Nebraska, its successors and assigns a permanent and perpetual easement for the construction, operation, access, maintenance, repair and placement and all purposes necessary or incident thereto across the following described real estate for a storm sewer system, to -wit: Beginning at the storm sewer manhole on south side and on south lot line of Tax Lot 279 of Section 7, Township 18 North, Range 12 East of the 6 P.M. located approximately 80 feet northeast of the southwest lot corner of said Tax Lot; thence northeasterly along the south lot line of said Tax Lot for a distance of 20 feet; thence turning northwesterly for a distance of 30 feet; thence turning southwesterly for a distance of 40 feet; thence turning southeasterly for a distance of 30 feet this point located on the south lot line of said Tax Lot; thence turning northeasterly 20 feet to the said storm sewer manhole point of beginning City of Blair, Washington County, Nebraska. The undersigned property owner hereby reserves the right to use and enjoy said real estate, except as may be necessary for the purposes herein granted to the City of Blair and provided that said owner shall not, without prior written consent of the City of Blair, construct or permit to be constructed any house, structure, -reservoir, pipeline or any other construction or excavation on, over or within said real estate description for the permanent easement as described herein. The City of Blair agrees to pay for all damages to fences and buildings on said land which may be caused by the exercise of the rights granted herein. The City of Blair hereby agrees to repair any significant holes which may occur during the term of this easement as a result of any undermining or erosion connected with the installation of said sewer line. This easement shall be binding upon the heirs, personal representatives, successors and assigns of all parties hereto.
