The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 2. No attempt shall be made by the permittee to prevent the hill and free use by the public of all navigable waters at or adjacent to the activity authorized by this permit. 3. There shall be no unreasonable interference with navigation by the existence or use of the activity authorized herein. 4. The permittee agrees to make every reasonable effort to prosecute the construction or work authorized herein in a manner so as to minimize any adverse impact of the construction or work on fish, wildlife, and natural environmental values. 5. All construction debris will be disposed of on land in such a manner that it cannot enter a waterway or wetland. 6. The permittee shall establish and carry out a program for immediate removal of debris during construction in order to prevent the accumulation of unsightly, deleterious and/or potentially polluted materials. 7. Equipment for handling and conveying materials during construction shall be operated to prevent dumping or spilling the materials into wetlands or the waterway, except as approved herein. S. Steps will be taken to prevent materials spilled or stored on site from washing into the wetlands or waterway as a result of cleanup activities, natural runoff, or flooding, and that, during construction, any materials, which are accidentally spilled into these areas, will be retrieved. 9. Clearing of vegetation must be limited to that which is absolutely necessary for construction of the project. All areas along the bank disturbed by the project must be reseeded with vegetation indigenous to the area, immediately following, or concurrent with the project to prevent erosion. 10. Construction activities in Missouri River (e.g., pile driving, coffer dam construction, etc) shall not occur from January 31 through July 1 to avoid impacts to the Pallid Sturgeon. If construction is planned or is delayed and needs to talk place during this timeframe the United State Army Corps of Engineers shall be contacted. Additional coordination will need to be conducted with Fish and Wildlife Service if construction will be taking place from January 31 to July 1 to determine effect to Pallid Sturgeon. 11. The enclosed metal plate shall be permanently displayed at the docking facility.
