Dear Mr. Olson:
Reference your application received by this office on June 30, 3009, requesting Department
of the Army authorization to repair an existing dock and to construct a new dock in the Missouri
River along the right descending bank at river mile marker 648.15. The work will be carried out
in accordance with plans received on June 30, 3009. This activity is located in Section 7,
Township 18 North, Range 12 East, Washington County, Nebraska.
After reviewing the information you provided, it is determined that a Letter of Permission is
appropriate and in the best of public interest. This authorization is issued under the provisions of
Section 10 of the River and Harbors Act which regulates all work or structures in or affecting the
course, condition, or capacity of navigable waters. of the Unites Sates. Any changes to your
proposed activity may require additional Department of the Army authorization.
The location and project details are specified on the enclosed map and drawings.
Authorization for your dock repairs and construction is subject to the enclosed conditions.
Also enclosed is a Notification of Applicant Options (NA) and a flow chart which explains
the options available to you in your evaluation of the enclosed conditions. The Final Rule
Establishing an Administrative Appeal Process for the Regulatory Program of the Corps of
Engineers was issued in the Federal Register on March 9, 1999. The rule became effective on
August 6, 1999. Permit conditions may be appealed as of March 9, 1999, however, the review of
Request for Appeal is not required to be initiated prior to August 6, 1999.
If you fail to complete the work or the structure(s) authorized herein before October 19,
2011, this Letter of Permission, if not previously revoked or specifically extended, shall become
null and void. If you need more time to complete the project, you must contact this office within
30 days before the completion date to request and receive extended approval.
The attached compliance certification form must be signed and returned to the address listed
upon completion of the authorized work and any required mitigation.
