Dear Ms. Frazer,
This letter is confirmation regarding our phone conversation on Friday, August 20, 2010 regarding the city's
maintenance of the city's culvert on the above property owned by you. While the culvert does belong to the
city, I have confirmed the city does not have an easement to this drainage area. We attempted to remove any
debris from the drainage area due to a complaint we received from Brandi Burdess indicating concerns
regarding the drainage of this area.
As per your request, since the city does not have an easement, the City of Blair will no longer maintain, remove
or keep this culvert debris free. You are now responsible to maintain this culvert and accept liability of this
drainage way. Please know that it is your responsibility to maintain the drainage way free of weeds, silt, and
debris and assure the drainage area will continue to flow freely and not hold water. If you wish to install any
type of erosion protection, you will need to use appropriate erosion materials as opposed to any miscellaneous
debris or broken concrete. The city will continue to maintain and perform routine maintenance of the storm
sewer south of your property including the manhole that is adjacent to your property on city right of way.
If you are not willing to accept this liability and to maintain this culvert debris free, please contact city hall, and
we will prepare easement documents for you to sign. If you have any questions or need additional information,
feel free to contact Allen Schoemaker, Director of Public Works. Thank you for your cooperation in this
matter.
