218287 1 ORDINANCE NO. 2182 COUNCIL MEMBER FANOLE INTRODUCED THE FOLLOWING ORDINANCE: AN ORDINANCE VACATING REAL ESTATE KNOWN AS PART OF LOT 11, BLOCK 4, PRAIRIE PARK ADDITION ALONG WITH THAT PART OF A VACATED ALLEY LYING ADJACENT TO SAID LOT 11, ALL LYING IN THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA; AND AUTHORIZING THE SALE OF SAID REAL ESTATE FOR THE SUM OF $1.00; PROVIDING FOR NOTICE OF SUCH SALE TO BE PUBLISHED FOR THREE CONSECUTIVE WEEKS IMMEDIATELY AFTER THE PASSAGE OF THIS ORDINANCE; AND TO MAKE ALL NOTIFICATIONS REQUIRED UNDER NEB. REV. STAT. §16-202, INCLUDING NOTIFICATION OF THE RIGHT OF REMONSTRANCE; PROVIDING FOR ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO BE REPEALED; PROVIDING THAT SAID ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FOLLOWING PASSAGE AND PUBLICATION AS REQUIRED BY LAW AND PROVIDING FOR PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA, AS FOLLOWS: SECTION 1. The described real estate known as Part of Lot 11, Block 4, Prairie Park Addition along with that part of a vacated alley lying adjacent to said Lot 11, all lying in the City of Blair, Washington County, Nebraska, and further described on Exhibit "A" attached hereto and incorporated herein by reference, is hereby vacated. SECTION 2. That if the Hain Flynn Post No. 154 of the American Legion agrees to convey to Robert J. and Marla Ryan, hereinafter referred to as "Ryans" any interest they may have in said real estate as described above by quit claim deed as such to the Ryans, the City of Blair hereby agrees to sell any interest the City of Blair may have in the real estate described hereinabove for the sum of $1.00 to Ryans. Further, the Mayor and City Clerk of the City of Blair, Nebraska are hereby authorized and directed to make all notifications required under Neb. Rev. Stat. § 16 -202, et.seq., including but not limited to notice of the sale and the terms thereof, and, if after the required remonstrance period has lapsed and City has not received a remonstrance against such sale signed by registered voters of the City equal in number to Thirty Percent (30 %) of the registered voters voting at the last regular municipal election held therein, then, the Mayor and City Clerk are authorized to execute and deliver any and all documents, deeds or other instruments necessary to effectuate such conveyance of real estate. 871 SECTION 3. Further, all quit claims deeds shall include a covenant that this real estate described above in this ordinance shall be appended to the adjacent real estate owned by the Ryans known as Lot 6, Bel -Air Addition to the City of Blair, Washington County, and the above described real estate and adjacent real estate owned by the Ryans shall not be transferred and assigned except in a simultaneous transaction to the same grantee or grantees, and said covenant shall run with the land. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. This ordinance shall be in full force and effect from and following the passage and publication hereof as required by law and this ordinance shall be published in pamphlet form and shall be in full force and effect from and after its passage as provided by law.
