COUNCIL MEMBER CHRISTIANSEN INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDINANCE VACATING A PORTION OF THE RIGHT -OF -WAY ALONG 10TH STREET
SOUTH OF THE INTERSECTION OF 10 AND SOUTH STREETS IN THE CITY OF BLAIR,
WASHINGTON COUNTY, NEBRASKA, RESERVING, HOWEVER, UNTO THE CITY OF
BLAIR A PERPETUAL EASEMENT FOR UTILITIES LOCATED IN SAID AREA, INCLUDING
BUT NOT LIMITED TO WATER AND SEWER LINES, REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING WHEN THIS
ORDNANCE SHALL BE IN FULL FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA, AS FOLLOWS:
SECTION 1. Tract 1: A parcel of land being a portion of 10th Street right -of -way in the
southeast quarter of the southwest quarter of Section 12, Township 18 North, Range 11 East of the
6th Principal Meridian, City of Bair, Washington County, Nebraska, more fully described as follows:
Beginning at the southeast comer of Tax Lot 162 in said southeast quarter of the southwest
quarter, said point being on the west right -of -way line of said 10th Street; Thence along said west
right -of -way line, north 00 degrees 01 minute 50 seconds east, 150.00 feet to a point on the south
right -of -way line of South Street; Thence along the easterly prolongation of said south right -of -way
line, south 89 degrees 58 minutes 10 seconds east, 63.22 feet to a point on a non - tangent curve,
concave westerly, to which point a radial line bears south 86 degrees 05 minutes 58 seconds east,
490.00 feet; Thence southerly, along said curve through a central angle of 05 degrees 52 minutes 43
seconds, 50.28 feet; Thence south 09 degrees 46 minutes 45 seconds west, 74.16 feet to the
beginning of a curve, concave easterly, having a radius of 460.00 feet; Thence southerly, along said
curve through a central angle of 03 degrees 23 minutes 55 seconds, 27.29 feet; Thence north 89
degrees 58 minutes 10 seconds west, 40.88 feet to the point of beginning. Said parcel contains an
area of 7,906 square feet (0.181 acre), more or less.
SECTION 2. Tract 2: A parcel of land being a portion of 10th Street right -of -way in the
southeast quarter of the southwest quarter of Section 12, Township 18 North, Range 11 east of
the 6 Principal Meridian, City of Blair, Washington County, Nebraska, more fully described as
follows:
Beginning at the southeast corner of Tax Lot 162 in said southeast quarter of the
southwest quarter, said point being on the west right -of -way line of said 10th Street; Thence
south 89 degrees 58 minutes 10 seconds east, 40.88 feet to a point on a non - tangent curve,
concave easterly, to which point a radial line bears north 83 degrees 37 minutes 10 seconds
west, 460.00 feet; Thence southerly, along said curve through a central angle of 12 degrees 59
minutes 19 seconds, 104.28 feet; Thence south 06 degrees 36 minutes 29 seconds east, 33.89
feet to the beginning of a curve, concave westerly, having a radius of 565.00 feet; Thence
southerly, along said curve through a central angle of 00 degrees 10 minutes 49 seconds, 1.78
feet; Thence south 89 degrees 22 minutes 53 seconds west, 45.27 feet to a point on said west
right -of -way line; Thence along said west right -of -way line, north 00 degrees 01 minute 50
seconds east, 140.00 feet to the point of beginning. Said parcel contains an area of 5,606
square feet (0.129 acre), more or less.
SECTION 3. Tract 3: A parcel of land being a portion of 10th Street right -of -way in the
southwest quarter of the southeast quarter of Section 12, Township 18 North, Range 11 east of
the 6th Principal Meridian, City of Blair, Washington County, Nebraska, more fully described as
follows:
Commencing at the northwest corner of said southwest quarter of the southeast quarter;
Thence along the west line of said southwest quarter of the southeast quarter, south 00 degrees 15
minutes 39 seconds east, 806.51 feet; Thence north 89 degrees 44 minutes 21 seconds east, 48.21
feet to the true point of beginning, said point being on the east right -of -way line of said 10th
street; Thence along said east right -of -way line, south 03 degrees 02 minutes 00 seconds west,
233.64 feet; Thence south 52 degrees 50 minutes 24 seconds west, 3.35 feet; Thence north 06
degrees 36 minutes 29 seconds west, 31.13 feet to the beginning of a curve, concave easterly,
having a radius of 395.00 feet; Thence northerly, along said curve through a central angle of 16
degrees 23 minutes 14 seconds, 112.97 feet; Thence north 09 degrees 46 minutes 45 seconds
east, 74.16 feet to the beginning of a curve, concave westerly, having a radius of 455.00 feet;
Thence northerly, along said curve through a central angle of 01 degree 57 minutes 44 seconds,
19.01 feet to the true point of beginning. Said parcel contains an area of 1,972 square feet
(0.045 acre), more or less.
SECTION 4. All parcels are hereby vacated and the ownership of the same, pursuant to Neb.
Rev. Stat. 16 -611, shall vest in the owners abutting property and become part of such property as
shown on "Attachment A ", providing, however, the City of Blair hereby reserves a perpetual
easement for utilities located in said area, including but not limited to water and sewer lines.
SECTION 5.A11 ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 6. This ordinance shall be in full force and effect from and following the passage
and publication hereof as required by law.
