VA 2009-2176~:~ ~ - 675 ORDINANCE NO. 2176 ~~F't~ `~- `.. i:~~~;~`?~ E~I~~ ~ E~z iii DEED COUNCIL MEMBER KEPHART INTRODUCED THE FOLLOWING ORDINANC~: ~E_i'.~~~, f'[~ AN ORDINANCE VACATING A PORTION OF THE RIGHT-OF-WAY ALONG 20TH STREET FROM FRONT STREET NORTH TO THE RAILROAD RIGHT OF WAY IN THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA, AS FOLLOWS: SECTION 1. The east and west sides of 20t~' Street from Front Street North to the Railroad right of way has excess right-of--way that is not necessary for the needs of the City of Blair. As a result, the area consisting of the east 10' and the west 10' of 20t~' Street right-of--way from Front Street North to the Railroad right of way is hereby vacated and the ownership of the same, pursuant to Neb. Rev. Stat. 16-611, shall revert to the owners of the adjacent real estate, on each side of said street. The City of Blair shall retain a utility easement over the vacated areas in order to construct, repair and maintain any and all utilities including but not limited to water, storm sewer, sanitary sewer, electric, natural gas, telephone, cable television, etc. SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. This ordinance shall be in full force and effect from and following the passage and publication hereof as required by law. PASSED AND APPROVED this 8TH day of SEPTEMBER, 2009.
