Greetings sir. Dave Chevalier met with you recently to discuss our interest in possible uses for
basements in downtown buildings. As you suggested, we are submitting this correspondence
detailing our proposed use of one particular commercial building basement.
As you know, Dave and I are the owners of a number of commercial properties in Blair. We are
particularly interested in the revitalization of the Washington Street area, as we believe the City
is. In November 2008, we purchased 1570 Washington Street, a building with a lot of history
that is considered to be a downtown icon. We hope to make it a destination place for locals and
others from the surrounding area.
The main floor of the building has been used for many years as office space, as has the second
floor. Presently, the second floor is occupied by Novazymes. The main floor has several
individual suites and we are presently occupying one for our use. There is a full basement in the
building which has a separate entrance/exit from the sidewalk on Washington Street and can be
accessed by an interior stairway as well.
It is our hope that the basement of 1570 Washington can be used as a gathering place for those
who enjoy fine wine and social interaction. Simply, we would like to utilize the approximate
1500 square feet of space in the basement of that building to be the new home of Vintner's
Gallery, a bar dedicated to serving fine wines and beers. We envision it becoming a place of
instant interest to local business people or anyone else looking for a special place to meet and
relax.
As you may know, the basement of 1570 Washington had been used for years as office space as
well. The unfortunate flooding we experienced at that location caused quite a mess and as our
clean~ up efforts got underway, a number of different people commented on what a great bar that
area of the building would make. We agree, and remain hopeful that the City will as well.
The design of the building allows entrance and egress from two separate means in the basement.

There are two bathrooms downstairs that can be made ADA compliant. The seating capacity
will be determined by the Fire Marshall, of course. It is our intention to apply for a full liquor
license with package sales included. We have been working with a number of California
wineries directly, and we believe it may be possible to bring wines to Blair which are not
presently available any where else in Nebraska. It is our opinion other local businesses would
be positively impacted by our proposed business. As it stands, there does not seem to be a bar
anywhere in the area offering the kind of ambiance that is immediately attractive to business
professionals ,their clients, and associates.
We fully anticipate there being an interest in renting space inside Vintner's Gallery, or the
entire bar for private functions of various types. Those will undoubtedly include business
meetings, club gatherings, private parties, receptions, and the like. It is our intention to have
special events with wine makers presenting their wares for tasting and having foods catered in.
We are unaware of anything like what we are proposing anywhere in Washington County. It is
our belief this proposed business will quickly become a popular and welcome addition to Blair.

not applied for the state issued liquor license as we are waiting to learn if our proposed use of the

Re: Use Exception Request for 1570 Washington Street
Dear Mr. Green:
As you know already, we are interested in opening a wine bar in the basement
of 1570 Washington Street. The pre-existing construction of the building has
two separate stairways leading to and from the basement but there is no
elevator and never was one.
We are constructing two bathrooms in the basement and each meets the square
footage requirements to be ADA compliant. We do have a hallway limitation
for doors that cannot be changed due to the existing boiler location and
positions of the bathrooms. The hallway only goes to the boiler room and a
one-person bathroom. It would be prohibitively expensive to move the boiler
and we are requesting an exception to that.
The basement of the building has been used for commercial purposes since
being built in 1881. Most recently, it has been used for office space. Our
proposed new usage would still involve the movement of people in and out of
the basement for a commercial purpose. We are anxious to work with the City
and look forward to being able to continue with our business plan. If you

BUILDING PERMIT DEPOSIT AGREEMENT
A $500.00 refundable deposit is being collected for any new commercial, new
residential, and any additions, remodels and accessory building valued $10,000 or
greater at the time of your building permit application.
A $200.00 refundable deposit is being collected for any residential remodel,
addition or accessory building valued under $10,000.
A $50.00 refundable deposit is being collected for all misc. permits.
The City reserves the right to not refund this deposit if any of the following
conditions occur during the construction period:
1) Theft of water service by the plumber, owner or general contractor.
2) All permits have not been obtained.
3) All required inspections have not been obtained.
4) Occupancy occurs prior to a final inspection.
5) The project is completed without a final inspection being done.
6) Storm Water Management Plan inspection not obtained. (If Required)
If any or all of these situations occur during construction, you may forfeit your
deposit.
I hereby agree to the above conditions, and understand that should any or
all of the above situations occur, the building permit deposit SHALL be forfeited or
discounted upon the discretion of the City of Blair, Building and Inspections

3. Show at least one handrail for the existing public exterior stair. Provide
signs at the top and bottom of the stairs that reads II USE HANDRAIL."
4. Show 60" turnaround circle or T on floor plan of the rest rooms. Show
fixture locations and grab bars. Show elevations of fixture dimensions,
height, and toilet paper dispenser location.
5. Show ADA signage and door hardware for restrooms.

1. Any assembly space located below the level of exit discharge shall be protected throughout by an
approved, supervised automatic sprinkler system at the level of assembly, and any level intervening
between that level and the level of exit discharge, including the level of exit discharge. LSC 12.1.6
2. Plan submitted does not indicate any doors in the basement, any door in a means of egress where
serving a room or area with an occupant load of 50 or more shall swing in the direction of egress travel.

6. Stairs shall be enclosed by one -hour rated construction extending from floor to floor and floor to the
underside of the roof deck, any opening in the stair enclosure shall be protected by 60 minute fire
resistance rated self - closing doors. LSC 12.3.1
7. Boiler room and any rooms or spaces used for storage shall be enclosed by one -hour rated
construction and 45 minute fire rated self closing doors or protected by automatic extinguishing systems.

8. Shop drawings for automatic sprinkler system shall be submitted for separate review and approval.
