Dear Mr. Fritz:
This letter serves as an official notification of our intent to declassify several areas located in PGLA-
1 Company located at 650 Industrial Drive, Blair, NE. PGLA-1 Company was set up to operate
using a solvent extraction process to produce Lactic Acid. Hence, the areas of the plant where solvent
was used was classified under the National Fire Protection Association (NFP A) as Class 1, Division
II, Group D. We have since changed our process such that we no longer use solvent, and our work in
decommissioning these areas indicates that we can now change the NFP A classification for these
areas to "Unclassified." Although we will maintain the automatic sprinkler systems in the facility,
under IBC 2006 we believe that the PGLA-1 buildings would be classified Factory Industrial, F2
(Low Hazard) in the same way as the Cargill Fructose Refinery and Polyols facilities are classified.
The PGLA-1 processes and equipment are very similar to these areas and we believe this is the
proper classification.
Since the startup of our plant in 1998, the process has changed and since 2003 we no longer use or
have solvent in the plant. Some of the old equipment and piping associated with this process
however, although abandoned, were still in place, including potential residual solvent leftover after
cleaning the piping and vessels. The design requirements and work precautions that come with this
classification have been in place until today.
In the last two years we have removed piping and cleaned or removed tames that were part of this
solvent/extraction process. In order to get at that point, the following tasks have been completed to
clean and/or remove the solvent tames and ancillary equipment to reclassify the areas.
· Outside tank area (1): the three (3) virgin solvent tames (TK-41102/ TK-41103/ TK-4l104)
and connecting piping have been cleaned out, and the old labels for solvent classification have
been removed. We now no longer have storage facilities for flammable products.
iii Outside tame area (2): the area that has five (5) storage tames and had a PBE-column in it
which has been stripped from piping that could have solvent in it. The same is valid for the
tanks: they all have been cleaned and now contain either Lactic Acid or intermediate product
The PBE column was removed and sold on June 3rd 2008.

<lI Main production floor, east side (2nd floor): all remaining solvent tanks and piping have been
cleaned or removed. All heat exchangers have been taken apart and rodded out.
<lI Main production floor, west side (1 st and 2nd floors): these areas did not contain solvent, but
previously fell within the impact radius of potential leaks, etc. Since the adjacent east side
of these two areas no longer contains solvent, the classification for these areas is no longer
applicable.
After internal discussions and a thorough investigation, we have eliminated the presence of any
residual solvent in all areas except the "Joe Room" located on the first floor. In the attached drawing
the Joe Room is marked with a "+"-pattern" The Joe Room, and an eight-foot radius around the Joe
Room (including the bioslulTY tank, acidulation reactors Band C, and the anions in the FE IX room -
see the striped area in the attached drawing) will remain as a classified area until equipment is
removed from the area. All other areas that we believe can be declassified, are marked with a dotted
pattern on the enclosed drawing.

records to reflect the new classification of all aforementioned areas. Should you have any questions
