The undersigned, owner of the real estate described herein for and in consideration of
One Dollar ($1.00) and other valuable consideration, mutual covenants and benefits to be derived
therefrom, does hereby give, grant, sell and convey unto the City of Blair, Nebraska, its
successors and assigns a permanent and perpetual easement for the construction, operation,
access, maintenance, repair and placement and all purposes necessary or incident thereto across
file foiiowing described real estate for a storm sewer system, to-wit:
The westerly 10.0 feet of Lot 3 and Northerly 10.0 feet of the vacated alley adjacent to
the westerly 10.0 feet of said Lot 3 in Block 82, Third Addition to the City of Blair, Washington
County, Nebraska.
The undersigned property owner hereby reserves the right to use and enjoy said real
estate, except as may be necessary for the purposes herein granted to the City of Blair and
provided that said owner shall not, without prior written consent of the City of Blair, construct or
permit to be constructed any house, structure, reservoir, pipeline or any other construction or
excavation on, over or within said real estate description for the permanent easement as described
herein.
The City of Blair agrees to pay for all damages to fences and buildings on said land
which may be caused by the exercise of the rights granted herein.
The City of Blair hereby agrees to repair any significant holes which may occur during
the term of this easement as a result of any undermining or erosion connected with the installation
of said sewer line.
This easement shall be binding upon the heirs, personal representatives, successors and
assigns of all parties hereto.

for water, sewer and storm sewer improvements by the City of Blair.
Also, it was discovered one of the easements had an incorrect legal description. Therefore, the
"Corrected Easement" has been enclosed for your signatures. Please sign and return the
"Corrected Easement" to us in the stamped, self-addressed envelope. For your convenience, the
easement can be notarized by me after it is returned, unless it is more convenient for you to sign
in the presence of a different notary.
