The City of Blair hereby authorizes the Washington County Register of Deeds Office to release the above-described "EASEMENT" on said real estate in that said violation has been satisfied in full. Wilson, husband and wife, hereinafter referred to as WILSONS, and the City of Blair, hereinafter referred to as BLAIR, and, WHEREAS, said BLAIR is desirous of constructing a water line connecting existing city water lines to a water well to be drilled by the said BLAIR and city water lines under construction, and, WHEREAS, WILSONS own real estate and have dedicated a street to the City of Blair through which said water line may be constructed described as: Tax Lot One Hundred Seventy-Two (172) and Tax Lot One Hundred Seventy-three (173) in Section Thirteen (13), Township Eighteen (18) North, Range Eleven (11) East of the Sixth Principal rleridian, Washington County, Nebraska, with the dedicated street being Prospect Avenue. and, WHEREAS, said BLAIR is desirous of obtaining a permanent easement through said land for the placement, operation and main- tenance of said water line NOW THEREFORE, for valuable consideration, receipt thereof being hereby acknowledged, WILSONS being the owners of the above- described tract of real estate do hereby give, grant, sell and convey unto said BLAIR, its successors and assigns, a permanent easement through said real estate hereinbefore described to con- struct, operate and maintain a water line including ingress and egress on, over, across and through the real estate described in said easement for all purposes necessary or incident to the exercise of the rights granted herein. Ai PAGE _ 5~; OFFICES OF O'HANLON & O'HANLON LAWYERS BLAIR, NEBRASKA I I G~ Record ~ General IVumerlCil Photostat {~~ 4 P ~ ~. ~ ' which are given to BLAIR by the dedication of said Prospect Avenue, and except as may be necessary for the purposes herein granted to said BLAIR and provided that said owners shall not, without prior written consent of BLAIR, construct or permit to be constructed any house, structure, reservoir, pipe line or other obstruction or excavation on, over or within said permanent easement, the descrip- tion of said permanent easement being as follows: That portion of Prospect Avenue lying East of 13th Street in the City of Blair, Washington County, Nebraska, as previously dedicated by the WILSONS to the City of Blair. The said BLAIR agrees to pay for all damages to growing crops, fences and buildings on said Tax Lot One Hundred Seventy- two (172) and Tax Lot One Hundred Seventy-three (173) and speci- fically excluding, however, the dedicated Prospect Avenue, which may be caused by the exercise of the rights granted herein. It is further agreed by the said BLAIR and WILS.ONS that said water line will be constructed and maintained at BLAIR`S expense and that said water line shall at all times remain the property of BLAIR. It is further agreed by the said BLAIR and WILSONS that if at any time subsequent to the construction of said water line, WILSONS develop the property for residential or commerical pur- poses, WILSONS shall have the right .to connect to said water line without the necessity of creating special water districts and subject only to the regular hook-up fee.
