Sorry, but I was out of town last week and did not get this written before I left. This letter is to inform you that Rebuilding Together - Washington County will not be able to work on the Hart Residence at 256 N 23`' Blair. We did provide a dumpster between July 30' and August 3 as we agreed to do. I was out of town on vacation during that time so I do not know if it was utilized or not, but we did provide it. The reason for not being able to work on this property is that at our last Board meeting on Friday, September 7, we still did not have an application from this family as required by our national office. Our work day is Saturday, September 22, and work teams had to be assigned at that meeting on September 7. I have made several attempts to contact the family but the phone is no longer in service. The deadline for applications was actually July 1, but we made an exception to attempt to assist you with this family. However because we still do not have an application, there is nothing more that we can do this year. Roof drains, gutters and downspouts shall be maintained in good repair and free from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance. 304.8 DECORATIVE FEATURES. All cornices, belt courses, corbels, terra cotta trim, wall facings and similar decorative features shall be maintained in good repair with proper anchorage and in a safe condition. 304.9 OVERHANG EXTENSIONS. All overhand extensions, including canopies, marquees, signs, metal awnings, fire escapes, standpipes and exhaust ducts shall be maintained in good repair and be properly anchored so as to be kept in sound condition. 304.10 STAIRWAYS, DECKS, PORCHES AND BALCONIES. All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage. 307.2 DISPOSAL OF RUBBISH. Every occupant of a structure shall dispose of all rubbish and garbage in a clean and sanitary manner by placing such rubbish in approved containers. 307.2.1 RUBBISH STORAGE FACILITIES. Toilet rooms and bathrooms shall provide privacy and shall not constitute the only passageway to a hall or other space or to the exterior. Water heating facilities shall be properly installed, maintained and capable of providing an adequate amount of water to be drawn at every required sink, lavatory, bathtub, shower and laundry facility at a temperature of not less than 100 degrees F (43 degrees C). A gas- burning water heater shall not be located in any bathroom, toilet room, bedroom or other occupied room normally kept closed, unless adequate combustion air is provided. We absolutely love our house and the surrounding neighborhood. However, I have a complaint that I believe is not being taken care of. One of our neighbors has a dog that is locked up in a kennel and has not been let out the entire time we have lived in our house. Some people come and feed the dog about once a week, and they feed it through a pipe. I work nights, so I am home quite a bit throughout the day. We don't live but a block from the train tracks, so I know when every train goes by. Unfortunately, the dog does too. It starts to howl even before I can hear the train coming. Earplugs have somewhat solved this problem, but I can still hear the dog. I guess the biggest complaint I have about the dog is that no one cleans the kennel out. With the warm days approaching, you cannot walk out our back door without getting a heavy dose of ammonia and feces smell to greet you. I have called animal control a couple of times, but he seems to have little concern for it. He claims that the house is vacant, and that the owner has recently passed away. When I told him that neither of these supposable facts were true, I got the feeling that he did not believe me. He informed me that he sometimes gives it dog treats- Why can he not do anything about it? There are also at least two dogs and numerous cats in the house that never get let out. I am not much of an animal activist, but this is not right. When we had that blizzard at the beginning of March, that dog sat outside in the almost zero temperatures for a little over a week before someone came and fed it. Section 704 Fire Protection Systems 704.1 GENERAL. All systems, devices and equipment to detect a fire, actuate an alarm or suppress or control a fire or any combination thereof shall be maintained in an operable condition at all times in accordance with the International Fire Code. 704.2 SMOKE ALARMS. May, 3, 2007 2:54PM BLAIR POLICE DEPARTMENT No,6538 P. 4 Incident Narrative 349971 CRIME /STATUTE: Follow -up NARRATIVE: On Tuesday May 2, 2007 I arrived at the residence of Betty Hark at 256 N. 23 Street in order to do a welfare check with the Department of Health and Human Services. I was accompanied by Judy Spaula of Adult Protective Services who had agreed to do a walk- through of the residence because of the alleged living conditions of the resident. We were also met at this location by animal control officer Rick Williams who had received reports of an excessive number of dogs and cats living at the home. Blair city building inspector Dale Miller accompanied us in order to examine and photograph the residence. We inquired as to whether we could look the residence over in regards to Ms. Hart's living conditions„ She became somewhat belligerent with Judy Spaula, but agreed to allow us to view the home. She also became somewhat agitated when Mr. Miller began taking pictures. The residence was filled with trash and clutter as well as a very strong odor of animal urine and feces. In the rear of the house Ms. Hart had several cats contained inside a room. Williams also counted three dogs that were living here and later explained to Mrs. Hart that only three animals were allowed by city ordinance, Williams informed her that the animals also needed their licensing and vaccinations updated„ On the upper floor of the residence, Williams and Miller discovered two rooms in which the floors were completely covered with animal feces. At this point we completed the walk through and left the residence„ A copy of this report should be forwarded to HHS for further consideration. Ms Spaula informed me that the party did not appear to present an immediate danger to herself, but the living conditions were extremely poor. She -also took the name of two female subjects who allegedly help clean the residence for Mrs. Hart and will later contact these parties„ However police involvement with this case is completed. May. 3. 2007 2:54PM BLAIR POLICE DEPARTMENT No.6538 P. 3 Incident Narrative 34997 CRIMEJSTATUTE: NHS Referral NARRATIVE: At 0909 hours April 27, 2007 Officer Robert Leehy and I arrived at the residence of Betty Hart at 256 N. 23` St. in Blair, Nebraska. We had earlier received a referral from Health and Human Services (the Adult protective Services section) relating that Mrs. Hart's residence was in an extreme .state of disarray, that she was living in the residence with several animals and was not properly taking care of the residence or cleaning up after the dogs and cats. At this location, Mrs. Hart met us on the porch. The front yard of the residence had not been mewed for some time and the porch was filled with clutter and assorted Junk. Upon approaching the house, Officer L.eehy and I were simultaneously overwhelmed by the smell of urine and feces coming from inside of the residence. Mrs. Hart also had a large .seemingly vicious dog inside the residence. We both agreed that it would be better to do the interview on the porch. I could see through the windows that the house was filled with clutter, uncollected trash and animal feces. I later visited with animal control Officer Williams who stated that Mrs. Hart formerly had twelve cats living inside the residence. When interviewed, Mrs. Hart told us today that only two of the cats remained inside, Williams informed me that the dog kennel to the rear of the house, where a third dog resides, 'is likewise in disarray even though he has been up to inspect the kennel area several times. Mrs. Hart seemed to be in control of her faculties but stated that she was having some difficulty keeping the home up since her husband died in December„ Williams also informed me that he has a number of pictures of the house and yard that have been delivered to City Hall. At this time my recommendation is to refer the case to Judy Spala with the Adult Protective Services section and to arrange a visitation by Mrs„ Sp.ala accompanied by Williams for her safety the containment of the animals.
