This is just a follow up to our phone conversation from this morning. I did contact Ms. Soto via her cell phone (510-
3460). I left a message that you and Geoff had given the ok for the pool fence to be completed no later than the night of
9-1-08. Which would give them all day on the 1st to complete the work. I left her the City Offices main phone number as
well as ours and asked that she call to confirm once the fencing around her pool was completed.

I just received a call from Mrs. Soto regarding her pool. She said that they did not get the fencing put up over the
weekend so they took the pool down for the year and will relocate it next season. She also said that they have the posts
put up in place for where the fence and pool will be next year.

This matter has been referred to me from the City of Blair staff. According to our
investigation, you have a swimming pool on your residence that holds over 24 inches of
water and you do not have at least a 4 foot barrier (meaning a fence or wall) which
surrounds the pool. With this letter you are being put on notice of this violation. If you do
not correct this situation by installing a fence or wall or removing the pool, 1 will be forced
to prosecute this matter to the full extent of the law.

Dear Ms. 80to,
It has come to the city's attention that you have an above-ground swimming pool on your
property located at 679 Sloth Street that does not have the appropriate barrier surrounding it.
According to the 2006 International Building Code adopted by the City of Blair, any swimming
pool that can hold over 24 inches of water must have a four foot barrier (fence or wall)
surrounding the pool. The sole reason for the barrier is for safety by controlling access to the
swimming pool. Enclosed is a copy ofthe code with the relevant sections highlighted.
If you would like to contest this issue and you believe that your pool holds 24 inches of
water or less, please call our office so that we may set up an inspection with our building
inspector. Otherwise, please make arrangements to have the appropriate fence installed or the
pool removed no later than Thursday August 14, 2008. A follow up inspection will be
completed on or about this date to ensure the fence has been constructed or the pool removed.
Also, a building pelmit to install a fence is required and may be obtained at Blair City Hall, 218
South 16th Street, Monday through Friday, 8:00 a.m. to 4:30 p.m.
