2008-26RESOLUTION NO. 2008 - 26
COUNCILMEMBER FANOELE INTRODUCED THE FOLLOWING RESOLUTION:
WHEREAS, the Nebraska Legislature has recently enacted LB 1096 which amends Nebraska
Revised Statute >35 -901 and relates to the collection and deposit of qualifying funds received by
volunteer fire departments that are under the direction of a municipality or taxing authority in the
State of Nebraska; and
WHEREAS, the Blair Volunteer Fire Department is a volunteer fire department as defined by
the statute and is under the supporting authority of the City of Blair, Nebraska and as such is
governed by this amendment to the existing law;
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF BLAIR, NEBRASKA that the City of Blair, Nebraska does hereby indicate that it
will adopt policies and procedures in order to comply with the requirements of LB 1096 passed by
the Nebraska Legislature relating to the collection and deposit of qualifying funds received by the
Blair Volunteer Fire Department.
BE IT FURTHER RESOLVED, that as a result, beginning July 17, 2008, all public funds as
defined by LB 1096 shall be collected by the Blair Volunteer Fire and Rescue Departments and said
qualifying funds shall be immediately turned over and deposited with the City of Blair Treasurer in
order to meet the requirements set forth by the Nebraska Legislature.
BE IT FUTHER RESOLVED, that this resolution shall remain in full force and effect until
July 17, 2009, unless terminated earlier by the Blair City Council.
BE IT FURTHER RESOLVED that the Mayor and City Staff for the City of Blair, Nebraska
are hereby authorized and directed to execute all necessary documents on behalf of the municipality.
COUNCILMEMBER SHOTWELLMOVED THAT THE RESOLUTION BE ADOPTED AS
READ, WHICH SAID MOTION WAS SECONDED BY COUNCILMEMBER FANOELE. UPON
ROLL CALL, COUNCILMEMBERS STEWART, SCHEVE, SHOTWELL, FANOELE,
CHRISTIANSEN, WOLFF, ABBOTT AND BIFFAR VOTING "AYE" AND
COUNCILMEMBERS NONE VOTING "NAY ", THE MAYOR DECLARED THE FOREGOING
RESOLUTION PASSED AND APPROVED THIS 8TH DAY OF JULY, 2008.
