Baertschi, On February 4, 2009, City Personal and a Blair Police Officer visited the above property based on a complaint received regarding an abandoned structure and junk accumulation on the above Tax Lot (See enclosed pictures). Based upon the pictures taken of this life safety issue, City Staff has hereby determined this property is in violation of the 2007 International Property Maintenance Code, as adopted by the City of Blair, Nebraska as well as the City's Municipal Code Section 4 -501 Nuisances, which states a nuisance is any condition or thing to be that exists and essentially interferes with the comfortable enjoyment of life and property or tends to depreciate the value of the property of others. A structure is considered unsafe if found to be dangerous to the life, health, property or safety of the public or occupants, if the structure contains unsafe equipment or is so damaged, decayed, dilapidated, structurally unsafe, or of such faulty construction or unstable foundation, that partial or complete collapse is likely. Unsafe Equipment shall include any boiler, cistern, heating equipment, elevator, moving stairway, electrical wiring or device, flammable liquid containers or other equipment on the premise or within the structure which is in such disrepair or condition that such equipment is a hazard to life, health, property or safety of the public or occupants of the premises or structure. Unlawful structure is one found in whole or in part to be occupied by more persons than permitted under this code, or was erected, altered or occupied contrary to the law. IT IS THEREFORE ORDERED, by the City of Blair, Nebraska that the owner(s) of record, as shown by the real estate records of Washington County, being: Gary L. Poulson and Sally J. Baertschi C/O Wanda Poulson 825 Meadow Drive Blair, NE 68008 of the above described property, must remove, demolish and dispose of properly said remains of the abandoned structure, remove any life safety issues which would include filling in an open cistern and unsafe basement and clearing all junk accumulation from the structure site as well as along the tree lines of the property lines to correct the violations that exist on the property on or before May 31. 2009. Failure to clear this property of the violation on or before the compliance deadline will result in this matter being turned over to the City Attorney for further legal action. If the recipient believes this compliance order or its contents were prepared in error or do not accurately reflect the current conditions of the property, a hearing may be requested before the City Administrator or his designated agent to give testimony and show cause why this order should not be issued against the property owner.
