RE: Removal of tree in city right of way
Dear Mr. & Mrs. Kern,
It has been brought to our attention that you have partially removed (cut down) a tree in city right of way
(ROW). All trees growing in the ROW that were planted before April 8, 2008 are city trees. Council policy
dictates that city staff will look at any city tree that an adjacent property owner believes should be removed and
follow a specific procedure to determine if and how the tree should be removed.
The policy gives the Director of Public Works the authority to decide if a city tree should be removed. If
he determines that the tree does not need to be removed, the adjacent property owner may elect to remove the
tree at their own expense. In this case, you partially removed the city tree without getting authorization to do so.
According to our Director of Public Works, Allen Schoemaker, he was never contacted regarding this tree.
Municipal Code Section 6-319.07 (enclosed for your reference) requires anyone removing a city tree to
"remove the stumps from said trees below the surface of the ground so that the top of said stump shall not
project above the surface of the ground." Therefore, you are requested to remove the remainder of the tree and
remove/grind the Stunlp prior to July 11, 2008. If you need additional time to complete this request, you will
need to contact me on or before the above date. Otherwise, the city will hire a registered tree contractor to
remove the remaining tree & stump and bill you for the removal.

City Tree at 1769 South Street
Brenda,
The property owner removed all of the large limbs on a city tree at 1769 South Street but has not removed the truck or
stump of the tree. We need to send them a notice informing them that they need to remove the tree trunk and stump.
The tree was healthy so the city would not participate in the cost of removal and the tree is now starting to grow out of the
trunk and I know in a few years the property owner will be asking to city to remove the trunk and stump at city cost.
